BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
AMMON, IDAHO THAT:
WHEREAS, certain lands and properties within the City of Ammon have been petitioned
for a change of zoning and zoning classification; and,
WHEREAS, the City of Ammon Planning and Zoning Commission has duly held a
hearing upon the application for change of zone and has given notice as required by law of the
hearings thereon; and
WHEREAS, the City Council of the City of Ammon has determined that it is not
necessary to hold a hearing before the City Council on the application for the change of zones,
NOW THEREFORE, be it hereby ordained by the Mayor and City Council of the
City of Ammon:

a. A petition for change of zone from PSC to R-1 and R1-A, relating to certain
property located within Ammon, Bonneville County, Idaho and more particularly
described hereafter was properly brought.
b. That Public Hearing (#2024-019) was held before the Planning and Zoning
Commission of the City of Ammon and recommendations were received from the
Planning and Zoning Commission
c. That the hearing followed proper legal requirements for advertisement of the
hearings.
d. That the proposed zoning classification of R-1 Residence Zone and R1-A

Based upon the application, the findings of the Planning and Zoning Commission, the record and
testimony presented, and the following additional findings of the City Council:

The Ammon City Council therefore finds as follows:
1. The City Council finds the request from Caliber Customs for the project known as the
Bridgewater Property Rezone to be in general compliance with the 2018 Comprehensive Plan.
Table 1 (below) summarizes these findings.
2. The City Council finds the request from Caliber Customs for the project known as the
Bridgewater Property Rezone to be in compliance with the zoning ordinance and protects and
improves the public health, safety and welfare. These findings are summarized in Table 2
(below).
3. If applicable: The City Council finds the request from Caliber Customs for the project known as
the Bridgewater Property Rezone to be in compliance with the Subdivision Ordinance.
4. The City Council finds the request from Caliber Customs for the project known as the
Bridgewater Property Rezone will not have a negative fiscal impact upon the existing citizens of
the City of Ammon.

annexation or other change to this title that may affect the official zoning map.
General Compliance It shall be the policy of the City to display and have available the most up to date

considered adopted after any ordinance effecting this Title as it relates to the
official zoning map of the City has been published.
Chapter 14 R-1 Residence Zone
10-14-1: GENERAL OBJECTIVES AND CHARACTERISTICS OF ZONE: The objective
in establishing the R-1 Residence Zone is to provide a residential environment
within the City which is characterized by somewhat smaller lot width and a
somewhat denser residential environment. Also characteristic of this zone are

residential amenities adequate to maintain desirable residential neighborhoods.
The principal permitted uses in the R-1 Residence Zone shall be single family
dwelling units and certain other public facilities which are necessary to promote
and maintain stable residential neighborhoods. This zone does not allow density
that will exceed four (4.0) living units per acre.
In order to accomplish the objectives and purposes of this ordinance and to
promote the essential characteristics of this zone, the following regulations shall
apply in the R-1 Residence Zone (see also §10-5 Supplementary Regulations to
Zones, §10-7 Special Provisions Applying to Miscellaneous Uses, §10-29
Subdivision Regulations, and §10-37 District Use Matrix).
Chapter 14A R1-A Residence Zone
10-14A-1: GENERAL OBJECTIVES AND CHARACTERISTICS OF ZONE: The
objective in establishing the R1-A Residence Zone is to provide a residential
environment within the City which is characterized by somewhat smaller lot
width. Also characteristic of this zone are residential amenities adequate to

containing two (2) single-family dwelling units as ordinarily referred to as

and maintain stable residential neighborhoods. This zone does not allow density
that will exceed four (4.0) dwelling units per acre.
In order to accomplish the objectives and purposes of this ordinance and to
promote the essential characteristics of this zone, the following regulations shall
apply in the R1-A Residence Zone (see also §10-5 Supplementary Regulations to
Zones, §10-7 Special Provisions Applying to Miscellaneous Uses, §10-29
Subdivision Regulations, and §10-37 District Use Matrix).
SECTION 3: CONCLUSION OF LAW
1. The City of Ammon is a municipal corporation organized under Article XII of the Idaho
Constitution and the laws of the State of Idaho, Title 50, Idaho Code;
2. Under Chapter 65, Title 67 of the Idaho Code, the City has passed a land use and zoning code,
Title 10;
3. If applicable, under Chapter 2, Title 50 of the Idaho Code, the City has passed an annexation
procedures ordinance, Title 11.

5. The City of Ammon has provided adequate notice for the review of this application.
6. The project meets the standards of approval under Title 10, Chapter 4, Amendments, Title 10,
Chapter 14, R-1 Residence Zone, Chapter 14A, R1-A Residence Zone, and the standards of
approval under the Local Land Use Planning Act of Idaho Code, Title 67, Chapter 65
SECTION 4: DECISION
THEREFORE, the Ammon City Council approves the Bridgewater Property Rezone subject to the
following conditions:
1. Development shall be subject to a Standard Development Agreement to be negotiated
between the Developer and the City.

Compliance
- On December 31, 2024, there are three Planning and Zoning Commissioners terms expiring. All
three Commissioners have agreed to be reappointed to another three-year term. These re-
appointments will expire on December 31, 2027.
- Title 2 Chapter 1 PLANNING AND ZONING COMMISSION: details the appointment,
qualifications, term of office, organization (rules and meetings), and duties of the Commission.
- 10-10-1: APPOINTMENT: A Planning and Zoning Commission shall be appointed as provided in
Chapter 65 of Title 67 of the Idaho Code and in Title 2, Chapter 1 of the codified ordinances of
the City of Ammon.
Summary of Analysis
1. . This re-appointment will be her second full term.
Kristi has an excellent attendance record and has brought insightful perspectives to the
Commission.
2. in January, 2022. This re-appointment will be his second full term.
Jason has an excellent attendance record and has supplied respectful input to the Commission.
3. Josh Rydalch began in May, 2018. He completed a previous Commissioners term. He was
appointed for a full term in January, 2019 and was appointed to a second full term in January,
2022. This would be his third full term. Josh has an excellent attendance record and provides
valuable insight as a Commissioner.
4. Two thirds vote of the Council is required for all of these re-appointments.
5. The appointments listed above will provide a full Planning and Zoning Commission with nine
members.

CHAPTER 10
PLANNING AND ZONING COMMISSION
SECTION:
10-10-1: Appointment
10-10-2: Powers and Duties of Planning and Zoning Commission
10-10-3: Submission of Building and Zoning Matters to Planning Commission
10-10-1: APPOINTMENT: A Planning and Zoning Commission shall be appointed as provided in
Chapter 65 of Title 67 of the Idaho Code and as provided in Chapter 2 of Title 1 of the codified
ordinances of the City of Ammon.
10-10-2: POWERS AND DUTIES OF PLANNING COMMISSION: The Planning and Zoning
Commission shall have the powers and duties as provided in Chapter 65 of Title 67 of the Idaho Code
and as provided in Chapter 1 of Title 2 of the codified ordinances of the City of Ammon.
It shall be the duty of the Planning Commission to make reports and recommendations to the City, the
Zoning Administrator and the Board of Adjustment created under this title with respect to the issuance of
building permits, conditional use permits, variances, alleged violations of the zoning ordinance and map
and amendments pertaining thereto.
Also, it shall submit plans to the Council respecting the long-range, comprehensive plan for the orderly
physical development of the City. The Commission may make suggestions for such changes as the
Commission feels to be desirable in the zoning regulations and shall study and make recommendations
for the laying out, widening, extending and locating of streets, roads and highways for the relief of traffic,
the future development, growth and beautification of the City in respect to its public buildings, streets,
parks, grounds and lands, in order to promote the public health, morals, safety and welfare of the
inhabitants thereof.
10-10-3: SUBMISSION OF BUILDING AND ZONING MATTERS TO COMMISSION: The Zoning
Administrator and the City shall submit all applications for conditional use permits, request for variances,
and proposed amendments to the zoning ordinance to the Planning and Zoning Commission prior to
acting thereupon.

BY-LAWS
OF THE
CITY OF AMMON PLANNING AND ZONING COMMISSION
ARTICLE I
NAME
The name of this body shall be the City of Ammon Planning and Zoning Commission.
ARTICLE II
PURPOSE
The purpose of this Commission is to promote the health, safety and general welfare of the citizens of
Ammon in the following manner:
1. By impartial and uniform administration of the City Planning and Zoning Ordinance to all
residents without exception.
2. By providing and administering Zoning Law which is reasonable to individuals and which is
not confiscatory or destructive to business and free enterprise which is the basic source of
tax revenue in Ammon.
3. By encouraging urban and urban-type development within the incorporated City of Ammon.
4. By ensuring that development on land is commensurate with the physical characteristics
of the land.
5. By continuously examining the Law for ways to improve it in order to guide the orderly
development and prosperity of Ammon without unnecessary restriction of the property
rights of the individual landowner.
6. By cooperating and working closely with Bonneville County and the City of Idaho Falls to
insure the orderly growth of the surrounding area.
ARTICLE III
OFFICERS
Section 1. The Planning and Zoning Commission shall elect a Chairman and a Vice-Chairman. It may
also create and fill any other office deemed necessary.
Section 2. The Chairman shall be elected at the first regular meeting following the beginning of the
calendar year.
The term of office shall be one year and no one shall serve more than two consecutive terms.
The duties of the Chairman shall be as follows:
1. To preside at all meetings of the Commission.
2. To approve the agenda.
3. To review the minutes of the meetings.

4. To appoint committees.
5. To keep open the line of communication between staff personnel, the Mayor, the
City Council, and the Planning and Zoning Commission, and the Chairman shall have
the full right of expression and vote.
Section 3. The Vice-Chairman shall preside at meetings and in all ways perform as Chairman in the
absence of the Chairman.
The term of office shall be the same as that of Chairman.
Section 4. In the event of a vacancy in office, a special election shall be held at the next regular
meeting.
ARTICLE IV
MEETINGS
Section 1. The kinds of meetings shall be regular, special, work sessions and public hearings.
All meetings shall be open to the public.
A quorum of a majority of the members is required to be in attendance for regular and special meetings.
Records open to the public shall be kept of all meetings, hearings, resolutions, studies, and action taken.
Records retention shall be as required by Idaho State Statute.
Section 2. Regularly meetings shall be held on a monthly basis for at least nine months each year for
the purpose of making decisions and recommendations to the City Council concerning items on the
agenda.
Section 3. Special meetings may be called by the Chairman or by a request from a majority of the
commission members for the purpose of making a decision on a specific item or items of business.
Section 4. Work sessions may be held at the discretion of the commission for the purpose of
discussion, study and information.
Section 5. Public hearings shall be held wherever required by statute and also when deemed
necessary by a majority vote of a quorum of the commission at any formal meeting.
ARTICLE V
VOTING
Section 1. Voting shall be by voice or as otherwise directed by the Chairman.
Section 2. At all meetings of the Planning and Zoning Commission each member present shall be
entitled to cast one vote.
Section 3. The affirmative vote of a majority of the quorum shall be required for the approval of any
voting matter.

Section 4. Members voting in opposition to a proposed sub-division shall be encouraged to present
their reasons in writing to the Chairman to be placed on file.
ARTICLE VI
Section 1 Amendments to these by-laws may be proposed by any member of the Commission,
provided all such amendments are presented in writing at a regular meeting.
Section 2. All members shall be given notice of proposed amendments.
Section 3. Voting will take place at the next regular meeting following the proposal of an amendment.
Section 4. If approved by a majority of the quorum, the amendment shall become effective
immediately.

A RESOLUTION OF THE MAYOR AND COUNCIL OF THE CITY OF AMMON, IDAHO, ESTABLISHING THE
DATES FOR ALL REGULAR CITY COUNCIL, PLANNING AND ZONING, AND TRAFFIC COMMISSION MEETINGS
FOR 2025.
WHEREAS, regular meetings of the City Council shall be held on the first and third Thursday of each
month at 6:00 p.m., and the second Thursday at 4:30 p.m. at Ammon City Hall located at 2135 South Ammon
Road, Ammon, Idaho. This schedule may vary by Council order; and,
WHEREAS, regular meetings of the Planning and Zoning Commission shall be held on the first
Wednesday of each month at 7:00 p.m. at Ammon City Hall located at 2135 South Ammon Road, Ammon,
Idaho. This schedule may vary by Commission order; and,
WHEREAS, regular meetings of the Traffic Commission shall be held on the second Wednesday at
9:00 a.m. at Ammon City Hall located at 2135 South Ammon Road, Ammon, Idaho. This schedule may vary by
Commission order; and,
WHEREAS, pursuant to Idaho Code § 67-2343(1), any public agency that holds meetings at regular
intervals of at least once per calendar month scheduled in advance over the course of the year may satisfy
this meeting notice by giving meeting notices at least once each year of its regular meeting schedule; and,
WHEREAS, the City has determined that listing all regular meetings of the Council and Commissions
to be held in 2025 would be beneficial to the residents of and visitors to the City of Ammon.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF AMMON,
IDAHO that the regular meetings of the City Council for 2025 are attached as Exhibit A. Regular Meetings
of the Planning and Zoning Commission for 2025 are attached as Exhibit B. Regular Meetings of the
