CONSENT AGENDA: 1. Accounts Payable Report: Exhibit A 2. Minutes: August 21, 2025 — Regular Meeting It was moved by Council Member Fulmer and seconded by Council Member Boyle to approve the Consent Agenda. Wessel, yes; Oswald, yes; Fullmer, yes; Slack, Absent; Boyle, yes; Hamberlin, yes. Motion passes unanimously with vote by roll call. PROCLAMATIONS 1. Constitution Week Mayor Coletti read the proclamation declaring September 17th through September 23rd Constitution Week. PUBLIC COMMENT REGARDING ITEMS NOT ON AGENDA (3 -minute limit) No public comment was presented. ACTION ITEMS: 1. Consideration of Resolution 2025-009 ROW Acquisition- (Micah Austin, City Administrator) Recommendation: Adopt resolution 2025-009 Summary of Analysis: 1. Following the annexation property located at the northwest corner of Sunnyside and 45th Street, it was discovered that there is a small strip of property in 45th Street that does not have a clear chain of title. For this reason, the northwest corner of Sunnyside and 45th Street could not be officially annexed in the City of Ammon. 2. Over the past two years, staff has worked with legal counsel to determine the best way to acquire the strip of property located in the middle of 45th Street. After consideration of several options, it was determined that the City of Ammon should seek quiet title to the property. 3. Resolution 2025-009 begins the process of seeking quiet title of the property through eminent domain. Adoption of the resolution is necessary for legal counsel to process with the next steps in the quiet title process. It was moved by Council Member Wessel and seconded by Council Member Oswald to approve Resolution 2025-009 as presented. Consideration of the Standard Development Agreement for Clarkside Industrial Park- (Cindy Donovan, City Planner) Ammon City Council Regular Meeting 09.04.2025 Page 2 of 4 City Planner Donovan presented the development agreement with the amendments requested by the Council at the Council meeting on August 21, 2025. It was moved by Council Member Fullmer and seconded by Council Member Oswald to approve the Clarkside Industrial Standard Development Agreement. Fall Fee Resolution - City Administrator Micah Austin read through all changes on fees and the reason behind the changes. Boyle questioned the higher fees on baseball/t-ball and asked about the reason behind the increase. It was stated to simply cover the rising costs. 2. Miscellaneous - Sheriff's Deputy Albright brought up complaints about the motorized bikes, causing safety issues on the roadways and asked about city codes concerning motorized bikes. City Administrator Micah Austin stated the City of Ammon does not have code against. Streets & Sanitation Director Tony Black stated he has received several calls about motorized bikes. Most riders are not licensed drivers and he believes there is a law stating that drivers of a motorized vehicle must be licensed. Mayor Coletti asked about the danger of a motorized bike compared to a regular bike. Regular bikes might go as fast as motorized bikes and cause as much of a hazard, but riders of bicycles are not required to be licensed. In Woodland Hills, he has noticed golf carts and side -by -sides, which seem more dangerous. Council Member Wessel asked Streets & Sanitation Director Tony Black if all trash trucks get a bay at the shop to park in. Black stated all trucks have a bay except one that is parked outside during the summer months but is moved indoors in the winter. Water & Wastewater Director Nathan Riblett provided an update on residential meter progress, which went from 6 last week down to 2. A lot of commercial meters have been installed and more are scheduled for next Tuesday. City Clerk Joanna Dahm asked the Council if anyone is still using Council Share to access the Agendas for the meetings. Council stated at this time they are not utilizing Council Share. Donovan discussed the September 3rd P&Z meeting presentation on increasing maximum lot coverage. The P&Z Commission asked for more data and comparisons to surrounding jurisdictions. Jake Young is going to do more research to confirm. Donovan spoke with the developer at Curlew Bend who said they are on track to pave Curlew Drive by the end of September. Also informed the Council that Title 10 amendments will be discussed at the next City Council Work Session. Ammon City Council Regular Meeting 09.04.2025 Page 3 of 4 Council Member Fullmer would like to discuss rep rioritizing funds for Greater Idaho Falls Transit (GIFT) at a future meeting. Also spoke on traffic issues on Western Ave, stated it feels like a county road and people are driving extremely fast. Council Member Oswald stated she would also like to discuss future funding for GIFT. Council Member Wessel asked City Planner Cindy Donovan for clarification on Curlew Drive paving. Donovan stated it will be done by the end of September. Council Member Wessel asked if it will be chip sealed this fall. Donovan stated chipping sealing is not done until a year after pavement. Mayor Coletti announced he signed a Proclamation on September 3rd, naming September 8th Tanner Scoresby Day. Tanner is an 18 year old Ammon resident who has cancer and is undergoing treatment. There is a website for helping to support Tanner. Council Member Boyle asked for an update on the Safe Haven Baby Box. City Administrator Micah Austin stated he had no updates. Mayor Coletti reminded everyone of the 9/11 event next Thursday at 7:30pm and encouraged everyone to check out the new 9/11 Memorial Monument in front of the Fire Station next door.
