1. Planning and Zoning Commission held Public Hearing #2025-020 on Wednesday, December 3,
2025. The Commission unanimously recommended approval.
2. The rezone request was presented to the City Council on December 18, 2025. The Council
moved to approve the rezone from R-1 to I & M-1.

1. The Commission held public hearing #2025-020 on Wednesday, December 3, 2025

SECTION 2: DECISION STANDARDS & PROCEDURES
Standards
• Unless otherwise stated by City Code, the Commission is a recommending body to the Council.
See Ammon City Code § 2-1-5 and §10-10 and I.C. § 67-6511(2) (zoning). Recommendations
from the Commission are not binding on the Council. The decision of the Council is constrained
to the record created at hearing and applicable law.
• Zoning decisions must consider applicable provisions of the comprehensive plan, local
ordinances and regulations, and applicable services of those political subdivisions who serve the
property. I.C. § 67-6511(2).
• Planning and zoning actions are entitled to a strong presumption of validity in application and
interpretation of local ordinances.
• Review of Council decision is subject to the following:
67-5279. SCOPE OF REVIEW — TYPE OF RELIEF.
(1) The court shall not substitute its judgment for that of the agency as to the weight
of the evidence on questions of fact.

(3) When the agency was required by the provisions of this chapter or by other
provisions of law to issue an order, the court shall affirm the agency action unless the
court finds that the agency’s findings, inferences, conclusions, or decisions are:
(a) In violation of constitutional or statutory provisions;
(b) In excess of the statutory authority of the agency;
(c) Made upon unlawful procedure;
(d) Not supported by substantial evidence on the record as a whole; or
(e) Arbitrary, capricious, or an abuse of discretion.
If the agency action is not affirmed, it shall be set aside, in whole or in part, and
remanded for further proceedings as necessary.
(4) Notwithstanding the provisions of subsections (2) and (3) of this section, agency
action shall be affirmed unless substantial rights of the appellant have been prejudiced.

• Chapter 1 Foreword, page 5: This Ammon Comprehensive Plan is intended to guide
development in the City of Ammon in a manner that achieves the shared vision expressed by its
citizens for the future of their city, their communities, and their neighborhoods.
• Chapter 2. Purpose, page 6: "This Comprehensive Plan is intended as a pathway for achieving a
shared vision for the future of the City of Ammon as it continues to age, change, and grow. The
plan will serve as a framework for decisions regarding existing and new developments in Ammon
for the foreseeable future."
Applicable Sections of Zoning Code to Application:
• Chapter 1 Purpose 10-1-2: PURPOSE: The zone boundaries and regulations made in
accordance with a comprehensive plan designated to promote the health, safety, peace,
convenience, and general welfare of the inhabitants of Ammon.
o A. To promote the orderly growth and development of the City in accordance with the
Comprehensive Plan.
o F. To protect property values
o I. To promote and foster a wholesome, serviceable, and attractive City.
• Chapter 1 Declaration 10-1-3: In establishing the zones, the boundaries thereof and the
regulations applying within each of the zones, due and careful consideration was given, among

other things, to the suitability of land for particular uses with a view to conserving the value of
buildings and encouraging the most appropriate use of land throughout the City.
• Chapter 4 Amendments 10-4-1: ORDINANCE AND MAP MAY BE AMENDED: This zoning
ordinance, including the map, may be amended, supplemented, changed or modified from time to
time, consistent with Idaho Code Title 67, Chapter 65. The official zoning map of the City shall
be amended after any re-zone, annexation or other change to this title that may affect the official
zoning map. It shall be the policy of the City to display and have available the most up to date
zoning map as possible. Any change to the official zoning map shall be considered adopted after
any ordinance effecting this Title as it relates to the official zoning map of the City has been
published.
• Chapter 13 RP-A Residence Zone (surrounding zone) 10-13-1: GENERAL OBJECTIVES
AND CHARACTERISTICS OF ZONE: The objectives in establishing the RP-A Residence Zone
is to provide a residential environment within the City which is characterized by smaller lots and
somewhat denser residential environment than is characteristic of the RP Residence Zone.
Nevertheless, this zone is characterized by spacious yards and other residential amenities
adequate to maintain desirable single-family residential conditions. The principal uses permitted
in this zone shall be single-family dwelling units and certain other public facilities needed to
promote and maintain stable residential neighborhoods. No single lot, regardless of the status of
platting in the RP-A Residence Zone shall contain more than one dwelling unit, except as
specifically allowed by this Title. This zone does not allow density that will exceed 2.5 living
units per acre.
• Chapter 25 I&M-1 Industrial and Manufacturing Zone (surrounding zone) 10-25-1:
GENERAL OBJECTIVES AND CHARACTERISTICS OF ZONE: The I&M1 Industrial and
Manufacturing Zone has been established as a district in which the primary use of the land is for
manufacturing, fabricating, processing and warehousing establishments. This zone is suited for
industrial uses because of the proximity to railroad tracks and streets and the availability of
utilities necessary for successful industrial use. While much of the land within this zone is
currently devoted to agriculture and other open-land uses, it is intended that manufacturing and
industrial uses shall be directed into this zone as the needs arise.
• Chapter 14 R-1 Residence Zone (current zone) 10-14-1: GENERAL OBJECTIVES AND
CHARACTERISTICS OF ZONE: The objective in establishing the R-1 Residence Zone is to
provide a residential environment within the City which is characterized by somewhat smaller lot
width and a somewhat denser residential environment. Also characteristic of this zone are
residential amenities adequate to maintain desirable residential neighborhoods. The principal
permitted uses in the R-1 Residence Zone shall be single family dwelling units and certain other
public facilities which are necessary to promote and maintain stable residential neighborhoods.
This zone does not allow density that will exceed four (4.0) living units per acre.
SECTION 4: FINDINGS OF FACT
Based upon the record and testimony presented to the Council, IT FINDS THE FOLLOWING FACTS:
Relevant Uncontested Facts
A. The property is currently zoned R-1 Residence Zone and is currently an empty lot.
B. The property is surrounded on the North and West by RP-A zoning, single-family detached
homes, I&M-1 Industrial and Manufacturing Zone to the south, and the railroad to the East.

C. The Comprehensive Plan Future Land Use Map depicts the property as low density residential.
Reasoned Findings on Relevant Contested/Conflicting Facts
D. The most viable access for the requested property is through property to the south that is zoned
I&M-1.
E. Development on this property would be considered infill development, which is encouraged by
the comprehensive plan (2018 City of Ammon Comprehensive Plan, Chapter 10, page 23). This
is acceptable infill development because it is deemed compact, economic and efficient.
SECTION 5: CONCLUSION OF LAW
1. The City of Ammon is a municipal corporation organized under Article XII of the Idaho
Constitution and the laws of the State of Idaho, Title 50, Idaho Code;
2. Under Chapter 65, Title 67 of the Idaho Code, the City has passed a land use and zoning code,
Title 10;
3. Under Chapter 2, Title 50 of the Idaho Code, the City has passed an annexation procedures
ordinance, Title 11.
4. The Council has authority to hear the applicant’s request pursuant to the Ammon Municipal
Code.
5. The City of Ammon has provided adequate notice for the review of this application.
6. The process adhered strictly to procedural requirements outlined in Idaho Code § 67-6535 and
Ammon City Ordinances (Section 10-4-4). A public hearing was transparently held, providing all
stakeholders with substantial opportunity to voice their positions and ensuring fair due process.
7. This requested proposal DOES COMPLY with the 2018 Comprehensive Plan BECAUSE:
a. Chapter 1 of the Comprehensive Plan anticipates a shared vision expressed by its
citizens. The proposal submitted is harmonious with the land use to the south.
b. Chapter 2 of the Comprehensive Plan anticipates preserving the character of existing
neighborhoods and ensuring new developments integrate harmoniously with established
areas for a shared vision. I&M-1 is a compatible zoning with existing land uses to the
south.
c. Chapter 10 of the Comprehensive Plan recommends locating industrial land uses near
major arterials with good access to highways and adjacent to railroad facilities. The
proposal has access to Sunnyside Road, an arterial, and is adjacent on the east to the
Eastern Idaho Railroad.
8. Understanding this is a request for a rezone, this requested proposal DOES COMPLY with the
zoning ordinance BECAUSE:
a. Ammon City Code § 10-25-1 (I&M-1 zone). The requested zone, provides for land uses
like manufacturing, fabricating, processing and warehousing establishments. This
property is suited for industrial uses because of the proximity to railroad tracks and major
streets.
b. Ammon City Code § 10-14-1 (R-1 Zone). This addresses the existing zoning. This parcel
was initially planned for residential use.

9. The proposed application DOES protect and improve the public health, safety and welfare
BECAUSE:
a. A rezone will provide for cohesive development in relation to the most viable property
access. Prevents single family homes and industrial land uses from sharing access to an
arterial road.
10. The proposed application WILL NOT have a negative fiscal impact upon the existing citizens of
the City of Ammon BECAUSE:
a. Rezone will allow for additional property taxes to be collected after the property is
developed.
SECTION 6: DECISION
THEREFORE, the Ammon City Council approves the proposed application subject to the
following conditions:
1. Development shall be subject to a Standard Development Agreement to be negotiated
between the Developer and the City.
SECTION 7: NOTICE TO APPLICANT OF RIGHTS
This is a final decision by the Council. Rights regarding final decisions by the Council are
dictated by City Ordinance; a regulatory taking analysis may be requested pursuant to Idaho Code
§ 67-8003; and an affected person aggrieved by a final decision may seek review of this decision
in accordance with Idaho Code § 67-6535 and Idaho Rule of Civil Procedure 84 after all remedies
have been exhausted under local ordinance.
The City Council of the City of Ammon hereby adopts these Findings of Fact, Conclusions of Law, and
Decision this 15th day of January, 2026.

1. Public Hearing #2025-019 was held before the Planning and Zoning Commission on Wednesday,
December 3, 2025. The Commission unanimously recommended approval of the amendment.
The hearing was properly notice in the Post Register and letters were mailed to twenty public
entities on November 14, 2025. No posting on the property was required however, the property
was posted with Public Hearing #2025-020 on November 18, 2025.
2. The City Council reviewed the request on December 18, 2025 and moved to approve the
amendment to the map.

RESOLUTION NO. 2026-001
A RESOLUTION ADOPTING AMENDMENTS TO THE COMPREHENSIVE PLAN
FUTURE LAND USE MAP OF THE CITY OF AMMON
WHEREAS, pursuant to Idaho Code Section 67-6508 the City has a duty to conduct a
comprehensive planning process designed to prepare, implement and periodically review and update its
Comprehensive Plan and the Comprehensive Plan Land Use Map;
WHEREAS, the City of Ammon Planning and Zoning Commission has conducted public hearing
#2025-019 on December 3, 2025, wherein requests and opinions from the public have been solicited and
considered;
WHEREAS, a notice of the proposed amendments to the Comprehensive Plan Future Land Use
Map were published in the Post Register prior to the hearing;
WHEREAS, the City Council of the City of Ammon desires to adopt the newly proposed
Comprehensive Plan Future Land Use Map to serve as a guide for future planning and zoning decisions
by the City;
NOW, THEREFORE, BE IT HEREBY RESOLVED by the Mayor and City Council of the City
of Ammon as follows:
1. The Comprehensive Plan Future Land Use Map dated January 18, 2024 and amended on January
15, 2026, prepared by the Ammon Planning and Zoning Department, a copy of which is available
at the City Offices and on the City Website of the City of Ammon and by this reference made a
part hereof, be and hereby is adopted as the official Comprehensive Plan Future Land Use Map of
the City of Ammon, Idaho.

ORDINANCE NO. 744
AN ORDINANCE TO AMEND THE ZONING CLASSIFICATION AND THE
ZONING MAP FOR CERTAIN LANDS LOCATED WITHIN THE CITY OF
AMMON; PARTICULARLY DESCRIBING SAID LANDS AND DECLARING
THE ZONING OF I&M-1 FOR SUCH PARCELS OF LAND;
PROVIDING FOR AN EFFECTIVE DATE.

BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
AMMON, IDAHO THAT:
WHEREAS, certain lands and properties within the City of Ammon have been petitioned
for a change of zoning and zoning classification; and,
WHEREAS, the City of Ammon Planning and Zoning Commission has duly held a
hearing upon the application for change of zone and has given notice as required by law of the
hearings thereon; and
WHEREAS, the City Council of the City of Ammon has determined that it is not
necessary to hold a hearing before the City Council on the application for the change of zones,
NOW THEREFORE, be it hereby ordained by the Mayor and City Council of the

- Approve Resolution 2026-002.
Summary of Analysis
1. Staff has written and will submit a grant application for the Transportation Alternatives Program
(TAP) through the Idaho Transportation Department.
2. TAP grants are administered by the Local Highway Technical Assistance Council (LHTAC).
3. The grant staff is submitting is summarized as follows:
● Sand Creek Pathway Project: $225,200. This project will pave the existing gravel
pathway that runs along the Sand Creek on the west side of the Simplicity/1st Street
Community subdivision. The pathway will be 8’ wide and approximately 3775’ long
starting on the north side of 1st street and running north to connect into the existing
paved pathway that runs through the Bridgewater neighborhood. If this project is
constructed it will create a continuous 1.2 miles of paved pathway that will connect
between Ammon Road and 1st Street.
4. If awarded, the total grant awards for the project, minus the match amounts, would be
$208,670.32. Without these grants, these projects will not be constructed.
5. As a requirement of the grant, the City Council must adopt a resolution for each grant
application stating that the City of Ammon is committed to the projects and committed to paying
the required match amounts.
6. The match amount for the project is $16,529.68.
7. By adopting Resolution 2026-002, the City Council has fulfilled one of the requirements of these
grant applications.
Financial Impact
- If awarded, the Street Fund would be utilized for paying the grant match of $16,529.68

RESOLUTION OF THE CITY OF AMMON STATING THE CITY’S MATCH COMMITMENT TOWARDS A
FEDERAL GRANT APPLICATION FOR THE TRANSPORTATION ALTERNATIVES PROGRAM FOR
CONSTRUCTION OF THE SAND CREEK PATHWAY PROJECT
WHEREAS, the Idaho Transportation Department has solicited grant applications for the Transportation
Alternatives Program (TAP), which is administered through the Local Highway Technical Assistance
Council (LHTAC); and
WHEREAS, the City of Ammon is submitting one grant application for the TAP program to pave a
bike/pedestrian pathway within the City of Ammon to benefit the community; and
WHEREAS, the Sand Creek Pathway is the TAP grant application the City of Ammon is submitting for
funding consideration; and
WHEREAS, the North Little Sand Pathway will require 7.34% of the total project as a local match, which is
approximately $16,529.68; and
WHEREAS, the City of Ammon is committed to paying this match amount and is fully responsible for its
share of project costs and the City of Ammon is able to pay the 7.34% local match; and
WHEREAS, the City of Ammon hereby certifies that the application, as submitted, is accurate to the best
of our ability.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and the City Council of Ammon, Idaho that the City
Council is committed to the North Little Sand Pathway project and all commitments it entails, including
the required federal match, if the project is selected for funding through the Transportation Alternatives
Program.
This Resolution will be in full force and effect upon the day of its adoption.

attached. He resides in the area where we were seeking a candidate.
3. A majority vote of the Council is required for this appointment.
4. This appointment will provide a full Planning and Zoning Commission with nine members.

10-10-1: APPOINTMENT: A Planning and Zoning Commission shall be appointed as provided in
Chapter 65 of Title 67 of the Idaho Code and as provided in Chapter 2 of Title 1 of the codified
ordinances of the City of Ammon.
10-10-2: POWERS AND DUTIES OF PLANNING COMMISSION: The Planning and Zoning
Commission shall have the powers and duties as provided in Chapter 65 of Title 67 of the Idaho Code
and as provided in Chapter 1 of Title 2 of the codified ordinances of the City of Ammon.
It shall be the duty of the Planning and Zoning Commission to make reports and recommendations to
the City, the Zoning Administrator and the Board of Adjustment created under this title with respect to
the issuance of building permits, conditional use permits, variances, and map and amendments
pertaining thereto.
Also, it shall submit plans to the Council respecting the long-range, comprehensive plan for the orderly
physical development of the City. The Commission may make suggestions for such changes as the
Commission feels to be desirable in the zoning regulations and shall study and make recommendations
for the laying out, widening, extending and locating of streets, roads and highways for the relief of traffic,
the future development, growth and beautification of the City in respect to its public buildings, streets,
parks, grounds and lands, in order to promote the public health, safety and welfare of the inhabitants
thereof.
10-10-3: SUBMISSION OF BUILDING AND ZONING MATTERS TO COMMISSION: The Zoning
Administrator and the City shall submit all applications for conditional use permits, request for variances,
and proposed amendments to the zoning ordinance to the Planning and Zoning Commission prior to
acting thereupon.
