Chairman Scott Wessel opened the meeting at 7:00 p.m. at the City Hall building located at 2135 South
Ammon Road. Steve Richards led the Pledge of Allegiance.

Chairman Scott Wessel read in the procedures for the hearings, and asked Ron Folsom to read a summary of hearing
2012-020. Ron explained that each hearing is for the changing of the comprehensive plan and the rezoning of each property. Chairman
Wessel opened the public hearing.
PUBLIC HEARINGS: 2012-020 - Rezone – R-1 to R2-A – Portion of Oakridge subdivision
: Ron was asked by the Commission
to explain the zone differences.
Shawn Finch, 5209 S Tappan, Idaho Falls, Idaho, represented the applicant. They are trying to sell these properties, but no
one is interested in assisted living units the way these are constructed. They would like to take the ten buildings in the center section
and connect them by pairs by putting a hallway between them so they can have 16 bed units instead of 8 bed units. The State requires

two staff members full time on each premise, and potential buyers have indicated they have insufficient staff with only 8 occupants
per building, but there is some interest in 16 bed units. Currently only two units have occupants, leaving most of the buildings sitting
empty and unfinished which is deteriorating the property values. They have small bedrooms, each with its own bathroom.
Cam Payne, 3180 Carolyn Lane, represented the Bank of Idaho. They now own the three unfinished buildings and the vacant
lots. For the undeveloped lots they do not want to build an apartment complex; they are looking more at duplexes or the like due to
lack of parking and insufficient lot depth. The finished buildings consist of the bedrooms surrounding a common area. They will not
function as single family dwellings, and are only useful for what they were built for which was assisted living. With Wal-Mart on the
west and R2-A land on the north, they don’t foresee attracting anyone interested in single family dwellings.
Lonnie Roach, 716 E Greenway Street said townhomes would fit on the dirt lots, but he didn’t know about parking. For the
existing buildings, space for no more than three cars in front of each one is the real limiter. The dirt lots can sustain at maximum two
unit townhomes.
CommissionerCindy Donovan does not want to change these properties into R2-A because of the density. There are
already a lot of apartments around this area, and she feels that there are enough other locations in the City for this zone that there is no
reason to change it.
Commissioner Donovan suggested that they let the R2-A go into the 10 lots already built on in the middle, and leave the
perimeter lots as they are zoned now.
Commissioner Robert Taylor moved to recommend the zone change as proposed. Commissioner Steve Richards seconded
the motion. 4 in favor and 2 against - the motion passed. Commissioners Tom Hunsaker and Cindy Donovan opposed the motion.
Cindy’s concern was that by re-platting they could possibly put apartments in this area and the density is already too high. There are
plenty of other areas in the City with vacant R2-A zoning and we should not have it here.
Commissioner Tom Hunsaker thinks some accommodation needs to be made, but rezoning all of this land to R2-A is too
much.
Commissioner Robert Taylor moved to update the comprehensive plan to include the rezone of this portion of the Oakridge
Subdivision. Commissioner Steve Richards seconded the motion. 5 in favor 1 against – the motion passed.
Commissioner Tom Hunsaker still had the same concerns as before and stated the rezone could not be approved without the
comprehensive plan amendment.

Public Hearing2012-022 – Rezone – PB and R1-A to C-1 – Unplatted Property – North of future John Adams, west of

Ron explained where the property is located and that it required a change to the Comprehensive Plan before it could be
rezoned.
Kurt Roland, Eagle Rock Engineering 1331 Fremont Ave Idaho Falls said his client would like to build storage units in this
area. They will build a buffer so there will be less noise than if it was as an R1-A zone. It will look nice. If this passes John Adams
will go through to Ammon Road. There will be no entrances to this property from Ammon Road.
Ron Poulsen, 943 Clara Court, is neutral on this rezone. It was his understanding that this was commercial property next to
him. H prefers lower intensity commercial such as a veterinary office over something as intense as a McDonald’s. He feels that there
will be less traffic with storage units and people only coming once in awhile. He would like to see the entrances further down John
Adams and not as close to the homes. He would like to see a brick wall instead of a steel building. His concern is the runoff of water
from that property going toward his property. He also has a concern about the traffic coming off John Adams onto Ammon Road, and
the need for traffic control devices.
Wynnette Butikofer, 3444 Leroy Drive wants to know if the storage units are guaranteed, or will they be able to put anything
in after the zone change has been made? Storage units would be acceptable, but other commercial uses would not.
Scott Butikofer, 3444 Leroy Drive opposes the zone change because of the effect it will have on the property values.

Ken Tuck, 3472 Leroy Drive said if it is changed to C-1 he could wind up with a McDonalds in his the backyard. He
wondered if PB already allowed storage units, and if it does would not be opposed to changing the R1-A portion to PB.
Jean C. Peterson, 1086 Midway said with storage units you would have to monitor the traffic. She has lived next to storage
units in the past and found that trash left by people renting storage space tends to blow into adjacent yards. Storage units should be
close to apartments and this land should be left PB. Jean feels the traffic on Midway will increase. If you keep professional buildings
they will keep the yards green and well kept.
Bruce Patterson, 939 Clara Court said if you change the zoning to C-1 anything can happen. Once it goes to C-1 there is no
guarantee what will be built on the property and he doesn’t want a fast food drive-in in his backyard. Bruce has no problem with
storage units if it was a guarantee that’s what would be built on the property.
Kurt Roland said if they could put storage units in PB they would not have a problem with leaving the east portion as it is.
Chairman Wessel closed the public hearing and the Commission discussed the proposal. The Commission felt C-1 zoning
would open too many unwanted businesses as allowed uses. Consideration to the storage units was discussed and the Commissioners
agreed they felt that storage units would be a less intense use than most businesses allowed in the C-1 zone. They felt that allowing
storage units in the PB zone would be reasonable. There was discussion that storage units could be allowed in the PB zone by the
clause in the zone allowing for “Other uses which have been ruled by the City Council to be similar to the uses hereinabove listed”.
Tom Hunsaker made the comment that the R1-A property was overdue for a rezone to PB. Cindy Donovan agreed that PB
would be a good neighbor.
Commissioner Cindy Donovan moved to recommend to City Council to change the comprehensive plan for the R1-A zoned
property from medium residential to light commercial. Commissioner Robert Taylor seconded the motion. All in favor – the motion
passed.
Commissioner Cindy Donovan moved to recommend to City Council to deny the request to rezone from PB and R1-A to
C-1. Commissioner Steve Richards seconded the motion. All favor – the motion passed. All Commissioners indicated they voted
against the C-1 rezone because of the allowed uses that came with the zone change request.
Commissioner Cindy Donovan moved to recommend to the City Council to rezone the R1-A property to PB. Commissioner
Robert Taylor seconded the motion. All in favor – the motion passed.
