The meeting was called to order by Chairman Doug Willden at 7:00 p.m. in the City Building at 2135 South Ammon
Road, Ammon, Idaho

Minutes October 5, 2005: Cindy Donovan motioned to approve the October 5, 2005, Minutes with
corrections noted. Bob Gustafson seconded. All in favor, the mOlion carried.
Public Hearint!s:
Linford Variance ReQuest - Side Yard Set Back: Chairman Doug Willden explained the public hearing process
and swore in those individuals desiring to testifY.
City Planning Director Ron Folsom presented slides showing the property location and vicinity. The
property is located north of East 21" South and West of Foothill Road, commonly known as 5997 South Pheasant
Drive, Ammon, Bonneville County, Idaho. The applicant is requesting a variance as the foundation he poured is four
inches closer to the property line than allowed by city code.
Larry Linford, 2646 Erwin Court, Idaho Falls, Idaho, testified that when the foundation was poured they
really couldn't tell by looking that it was four inches off. Mr. Linford stated that he has attempted to purchase a strip
of property to bring the construction into code, but has been unable to reach an agreement with Mr. Hackbarth.
Construction of the home has been halted by the Building Official until code compliance is achieved.
Colby Hackbarth, 6029 Pheasant Drive, the neighboring property owner testified that he is opposed to
allowing a variance. Mr. Hackbarth believes it was known that the placement of the foundation was out of code
before they poured. In addition, Mr. Hackbarth indicated lhat the Linford's had reneged on an offer of landscaping.
Linda Linford, 2646 Erwin Court, Idaho Falls, Idaho, submitted a letter from Mr. Hackbarth and stated that
he had reneged on their agreement.
Chairman Willden closed the public hearing.
The Commission discussed the request and concluded that it does not meet the criteria for allowance of a
variance.
Greg Maeser motioned to recommend denial as the request does not meet variance requirements and, if the
applicant wants to take the request to the City Council, they should hold another public hearing to gather more
information. Rodney Allen seconded. All in favor, the motion carried.
Planning & Zoning 11102/2005 - I
Action Items:
I" Amended Plat Lincoln Industrial Park: City Planning Director Ron Folsom presented slides showing the
property location and vicinity. The property is located on the south side of 14" North in the Lincoln Industrial Park.
Alan Cunningham, 1020 Lincoln Road, of Mountain River Engineering addressed the Commission. The
property owner is seeking the amended plat to join lots 9 and 10, creating lot 14.
The Commission discussed the proposed amended plat.
Cindy Donovan motioned to recommend the City Council approve the I" Amended Plat of Lincoln
Industrial Park as presented. Jarin Hammer seconded. All in favor, the motion carried.
Zion's Bank Site Plan: City Planning Director Ron Folsom presented slides showing the property location and
vicinity. The property is located at the south east comer of25" East (Hitt Road) and Sunnyside Road.
The Commission discussed the proposed site plan.
Jarin Hammer motioned to recommend the City Council approve the Site Plan as presented, with noting that
if the building has a finished basement additional parking will be required. .Rodney Allen seconded. All in favor,
the motion carried.
Trailwood Division 9 Lot 28 Site Plan: City Planning Director Ron Folsom presented slides showing the property
location and vicinity. The property is located on the west side of Midway at the intersection with Moss. The zoning
of this lot is split between R2-A and Rl-A. Current policy is that construction on split-zoned lots must comply with
the most restrictive zone. The policy question has been placed on the Council Agenda for their November 3
meeting.
The Commission discussed the split-zone policy issue. Mr. Folsom reported on the approaches and policies
of other governmental entities in the region. Chairman Willden indicated to the Commission that under the historical
policy of compliance with the most restrictive zone the Commission must deny the request. If the City Council is
considering changing the policy, the Commission should table lhe request until the Council's ruling has been made.
Casey Dennert of Benton Engineering address the Commission on the developer's behalf. They ask that the
Site Plan be considered and action be taking pending and contingent on the Council addressing the split-zone policy.
Tom Hunsaker motioned to recommend the City Council deny the site plan, even if the split-zone policy is
changed, as it does not meet the minimum requirements of the R2-A zone. Bob Gustafson seconded. All in favor,
the motion carried.
Preliminarv Plat - Ratliff Propertv: City Planning Director Ron Folsom presenled slides showing the property
location and vicinity. The property is located at the north-west corner of 17" Street and Ammon Road.
The Commission discussed the preliminary plat.
Bob Gustafson motioned to recommend the City Council approve the Ratliff Preliminary Plat as presented.
Jarin Hammer seconded. All in favor, the motion carried.
DISCUSSION ITEMS:
Rockwell Condominium Proposal: City Planning Director Ron Folsom presented slides showing the property
location and vicinity. The property is located along the south side of I" Street in Centennial Ranch Division 15.
The developer is considering proposing an plat amendment for a portion of the division for development of a
condominium community. No action is being requested at this time. The developer is requesting preliminary
comments on the concept.
Paul Johnson of Rockwell Development explained the concept to the Commission. The Commission
discussed the state condominium requirements. Members voiced favorable views of the concept.
Proposed Chanees to Title to/Chapter 34 - Sien Ordinance: The Commission discussed the proposed changes to
Title 10 and, the addition of Chapter 34 governing signs.
Cindy Donovan reported that the City of Idaho Falls Planning Commission recommended approval of the
metes and bounds annexation and requested R-l Zoning for property north ofEITC, south of John Adams Parkway
and west of the Ammon City limits along 25th East.

Tom Hunsaker reported on the County Planning and Zoning Commission action regarding the industrial
park located north of Lincoln Road on the west side of North Ammon Road
