Planning Minutes 08/02/2006 CITY OF AMMON PLANNING AND ZONING COMMISSION August 2, 2006 MINUTES The meeting was called to order by Chairman Cindy Donovan at 7:00 p.m. in the City Building at 2135 South Ammon Road, Ammon, Idaho Members Present: Cindy Donovan, Chairman Jarin Hammer, Vice Chair Tom Hunsaker Rodney Allen Leslie Folsom Greg Maeser Richard Jaussi Members Absent: Steve Crandall Robert Gustafson Tristan John City Officials Present: Ron Folsom, Planning Director Bill Manwill, City Engineer Gay Leming, Deputy Clerk Jarin Hammer led the Pledge of Allegiance to the Flag. Minutes June 7. 2006 & Julv 5. 2006: Jarin Hammer motioned to approve the June 7, 2006, minutes with corrections noted. Richard Jaussi seconded. All in favor, the motion carried. Tom Hunsaker motioned to approve the July 5, 2006, minutes with corrections noted. Richard Jaussi seconded. All in favor, the motion carried. ACTION ITEMS: Reauest for Variance Set-Back from Street Ri2ht-of-Wav - Ea2le Point Division #10 City Planning Director Ron Folsom presented slides of the location and vicinity. The property is located south of 17th Street and west of 45th east in the south east comer of the Eagle Point Addition to the City of Ammon. The requested variance is to allow homes to be built with a 25 foot set-back from the street right-of-way rather than the 30 foot set-back required by City Code. The developer feels this will ensure they are able to keep the homes out of the portion of each lot that is in the flood plain. Alan Cunningham, 1020 Lincoln Road, of Mountain River Engineering, presented the request for the developer. The goal in requesting the variance is to ensure that the homes built in the subdivision are outside of the flood plain. Lee Gagner, 2555 Fieldstream Lane, Idaho Falls, testified that he does not want any of the homes to encroach on the flood plain. They will design the homes to set back between 25 and 30 feet. The depth ofthe lots vary from 170 to 210 feet. He feels that building with the current set back would deprive the buyers of privileges enjoyed by current home owners in the same zone, specifically it would limit the design features in the division. Roth Rice who lives at the comer of Crowley Road and Sunnyside stated that there has not been a flood plain study done in this area in 44 years. Lee Gagner indicated that the road has been moved north from the preliminary plat so that no house will have to be in the flood plain even without the requested variance. The Commission discussed the requested variance. Greg Maeser motioned to recommend approval of the Eagle Point # 1 0 variance as requested. Jarin Hammer seconded. Three in favor, Four opposed: Rodney Allen feels the homes can be built without encroaching Planning & Zoning 08/02/2006 - 1 in the flood plain; Leslie Folsom feels limiting variability in design does not pose a hardship; Cindy Donovan also feels there is no hardship as homes can be built without the variance; Richard Jaussi agreed. Eag:le Point Division #10 Final Plat: City Planning Director Ron Folsom presented slides of the proposed Final Plat. Alan Cunningham, 1020 Lincoln Road, of Mountain River Engineering presented the proposed fmal plat for the developer, and explained the changes from the preliminary plat. Leslie Folsom motioned to recommend approval of the Eagle Point Division #10 Final Plat as presented. Richard Jaussi seconded. All in favor, the motion carried Vacation Request - East Clayton Street (Within County): City Planning Director Ron Folsom presented slides of the street and vicinity. The location is South of the Stonehaven subdivision and East ofHitt Road. The request is purely advisory as the property is not in the City Limits. The Commission is asked to advise the Counsel as to a recommendation to the County. The applicant is requesting the County vacate Clayton Street and replat to have four lots facing Wackerli rather than the existing lots facing Clayton Street. The Commission discussed the proposal. Jarin Hammer motioned to recommend denial of the vacation because it is premature. Leslie Folsom seconded. All in favor, the motion carried. DISCUSSION ITEMS: The Commission discussed the effectiveness of the new public hearing procedures. It was decided that citizen's desiring to testify need to have their sign up sheets turned in prior to the beginning of the hearing they wish to testify in. The 17th Street Transition Development Plan was scheduled to be discussed at the Commission's September work session.
