Jason Lance, 5020 Brennan Bend, addressed the Council, requesting the variance. Mr. Lance began
constructing an accessory building in the side yard of his property. A building inspector contacted Mr. Lance as
there was not a building permit issued for the structure, which appeared to exceed the 120 square foot maximum.
Site plan review revealed that the current location of the building is not in compliance with the zone.
The Commission reviewed the request and the requirements for granting a variance.
Doug Willden motioned to recommend denial of the variance request as it does not meet the criteria for
granting of a variance. Richard Jaussi seconded. All in favor, the motion carried.
Greg Maeser motioned that although the Commission cannot legally allow the variance if there was a way
it wouldn’t be a problem. Eight for, Cindy Donovan opposed, Tom Hunsaker abstained. The motion carried.
Cottonwood Hills Estates Division #3 Final Plat: City Planning Director Ron Folsom presented slides of the

the applicant for five years and feel she will do a great job with this school. The school will also work with
handicapped children.
Caisa Call, 585 Crimson, Idaho Falls, testified in favor of the conditional use permit. Ms. Call is a
teacher with the school and wants to keep teaching there.
Emily Imberi, 500 Davidson Drive, Idaho Falls, testified in favor the conditional use. Ms. Imberi is a
parent of a child in the school. She believes that this school has helped her child greatly and will help many
others.
Matthew Smith,1675 Curlew Drive, Director of the Children’s Center testified in favor of the conditional
use permit. Mr. Smith stated that the program is very effective for handicapped children.
Lara Rooney, 4390 Amber Lane, testified in favor of the conditional use permit. Ms. Rooney stated that
her child has retained love of learning following being moved into this school. This is a school for special needs
kids.

Leslie Folsom motioned to recommend the City Council approve the Cherry Creek preliminary
site plan, addressing the clearance/visibility issue at the south east corner of the driveway. Jarin Hammer

Hawkins Smith Vacation of Ann Avenue and Parking Variance requests
: Notice of the Hearings were
published in the Post Register on January 18 and January 25, 2006. Notice of the hearings were also
mailed to property owners within five hundred (500) feet of the subject property and, to other parties of
interest.
City Planning Director Ron Folsom presented slides of the location and vicinity.
Kenny Christensen, 1951 South Saturn Way, Boise, addressed the Commission. The vacation
request is for that portion of Ann Avenue between Eagle Drive and the private drive on the east edge of
the Sunnyside Chevron property. The parking variance request is to allow nine foot width of parking
spaces, consistent with the completed portions of the Hawkins-Smith development. The requests have
been made to facilitate the development of a Kohl’s department store. Easements for utilities and access
will be provided in the amended plat.
Tom Arave, , testified that he is not opposed to the vacation of Ann Avenue as long as access to
his property from Eagle Drive is maintained.
Joe Gents, , Kohl’s Representative, testified that the company is concerned for the
safety of pedestrians in their parking areas. Stop signs will be installed in front of the store.
Chairman Donovan closed the public hearings.

AREA. THE ONLY OTHER VIABLE OPTION IS TO PUT UP ANOTHER POLE. MR. HANSEN
INDICATED THAT MOST CITIES IN THE NORTHWEST ARE ENCOURAGING CO-LOCATION

station could be problematic as traffic will be blocked when somebody is filling tires. However,
there does not appear to be a better place.

The Commission reviewed and discussed the proposed site plan. There were concerns regarding
safety with people cutting through the parking area to other businesses. In addition, Sunnyside is
becoming a major entrance into Ammon, the back of a building is not what the people of Ammon want
visitors to see first.
Jarin Hammer motioned to approve with landscaping and berms along Sunnyside and Eagle
Drive; the back of building to look the same as the front; traffic control devices to be installed; and
participation in the cost of the traffic signal at Eagle Drive and Sunnyside. Leslie Folsom seconded.

Camille Clifford, 5556 South 45 East, addressed the Commission. Ms. Clifford voiced her
concern that the development will create problems with the drainage of irrigation water through
and from her property.
Allan Cunningham, 1020 Lincoln Road, of Mountain River Engineering answered the
Commission’s questions regarding the drainage issue and the plat. The developer is aware that they
have to make provisions for the drainage. The improvement drawings will reflect how the issue is
being addressed. The water must be diverted through the storm drainage system.

Robert Montgomery, 5652 South 45 East, asked if it would be possible to run the water
back into the ditch instead of the storm drains. Mr. Montgomery was informed that regulations
prohibit drainage through a subdivision back into the irrigation system.
The Commission discussed the proposed final plat.
Tom Hunsaker motioned to recommend the City Council approve the Cortland Ridge Division #2
Final Plat with the provision that the improvement drawings show how the run-off water is being
handled. Bob Gustafson seconded. All in favor, the motion carried.

City Planning Director Ron Folsom reported that the developer does not want to proceed with the
amended plat at this time.
Walgreen Division #1 Final Plat: City Planning Director Ron Folsom presented slides of the
location, vicinity and proposed final plat.
Mike Bischoff, of Benton Engineering, presented the request for the developer and
answered the Commission’s questions. There have not been any changes from the preliminary plat.
The Commission reviewed the proposed final plat.
Bob Gustafson motioned to recommend the City Council approve the Walgreen Division #1
Final Plat as presented. Steve Crandall seconded. All in favor, the motion carried.
Walgreen Site Plan: City Planning Director Ron Folsom presented slides of the location, vicinity
and proposed site plan.
Mike Bischoff, of Benton Engineering, presented the request for the developer and
answered the Commission’s questions.
City Engineer Bill Manwill stated that there will need to be coordination between
Walgreen’s contractor and Mountain River Engineering to ensure proper separation of sewer and
water lines.
The Commission discussed the proposed site plan.
Tom Hunsaker motioned to recommend the City Council approve the Walgreen Site Plan as
presented, with the requirement that Walgreen’s coordinate with Mountain River Engineering on
the installation of the sewer lines to ensure property separation of water and sewer lines. Greg
Maeser seconded. All in favor, the motion carried.
Election of Commission Officers for 2006: The Commission discussed nominations.
Doug Willden motioned to elect Cindy Donovan as Chair and Jarin Hammer as Vice
Chairman for 2006. Rodney Allen seconded. All in favor, the motion carried.
