The meeting was called to order by Chairman Quinn Simmons at 7:00 p.m. in the City Building at 2135
South Ammon Road, Ammon, Idaho. Rick Butler led the Pledge of Allegiance.

September 7, 2011: Commissioner Steve Richards moved to approve the minutes, as
presented. Commissioner Tom Hunsaker seconded the motion. All in favor – the motion passed.

PUBLIC HEARINGS: 2011-015 – Communication Tower – 17 Street & Crowley – Eagle Pointe,
Division7, Block7, Lot 17
Chairman Quinn Simmons opened the public hearing and explained the hearing process to the public.
There was no public comment and no written comment was received.
Ron explained the location of the Communication Tower and informed the Commission the location has

no physical address, but it is located at 17 and Crowley. The tower is directly behind the property where the
strip mall is on 17th Street. Ron said the location requested meets the 200 foot setback requirement for this
zone.
Megan Fuller, Fuller Consulting, 4835 N. Villa Ridge Way, Boise, Id.83703, said she is representing the
applicant as ATT New Singular Wireless. Megan said the reason ATT would like this site is for a better service
area for their customers that are having difficulty with service now. Ron said the tower is on leased property.
Megan said there is service there and if you used your ATT phone you would probably have service, but the
tower currently serving this area is far away and it is reaching its capacity. Megan said the tower will be set
back behind another structure and will be hidden from view.
Rocky Madison, Construction manager with Blackened Beach, 11053 Two and Half Mile Road,
Pocatello. Tom asked what the diameter of the tower is at the base. Rocky said if they design the tower for
three carriers, it will be close to 40 inches at the base. Tom asked what the distance was from the furthest out
point of the laterals back to the face of the tower and the distance of the furthest out antenna back to the face of
the tower. Rocky said the boom arms are typically four feet long and the laterals or horizontals are about ten
feet long, and the furthest antenna back to the pole is six to eight feet.
Tom stated the ordinance requires the most distant point on the laterals and on the antennas to be no
more than 48 inches. Tom read the ordinance to let them know that they need to get closer to the building to
qualify for a type 2 Cell Tower. Discussion ensued with the Commission about the interpretation of the setback
from the building. It was determined the language was confusing and could be interpreted differently. The
Commission members agreed that the placement of the proposed tower would meet the intent of the ordinance.
Tom also explained that all equipment that makes a noise must be housed inside of a building.
Megan said every effort has been met to make sure the tower is in compliance. Sometimes they over
estimate what they will need and that is what has happened here. The equipment building will be low key with
pebble exterior walls, no metal cabinets, and the generator can be housed in the same type of structure. The
towers are not climbable and they are approved by OSHA. If the City doesn’t want the barb wire on the fence
they can work around that.
Commissioner Steve Richards moved to approve a conditional use permit for the communication tower.
Commissioner Rick Butler seconded the motion. All for – the motion passed.

DISCUSSION ITEMS:
1.Comprehensive Plan Draft:
The commission reviewed the current draft. Ron would like any changes
sent to him immediately so he can complete the text.
2.Assisted Living:
The commission discussed which zones would allow an assisted living center.
Tom said R2-A allows for up to eight units for apartment buildings and it also allows rest homes for not more

than 20 guests. Ron said a 16 living unit facility would fall under the same allowance as a rest home and is
really an apartment complex and would be allowed in an R2-A zone and up.
3.PUD Commercial Size:
Thecurrent requirement is a limit of no less than 20 acres. The
commission discussed that in a residential area this is fine but in commercial areas we would like to drop it to
maybe 5 acres which is what it originally was.
