Council Minutes 9/12/2006 (172) I I I -, I 206 May 4, 1995 CITY OF AMMON May 4, 1995 Minutes of the Regular Meeting of the Mayor and City Council: The meeting was called to order at Street, Ammon, Idaho, by Mayor C. present: Mayor C. Kathy Dansie Others Present: Bruce and Patricia Bird, 3260 Western Avenue, Ammon Jill Hobbs, 2165 Cabellaro Drive, Ammon Sue Gloschat, 2045 Midway Avenue, Ammon George Watkins III, 2155 Midway Avenue, Ammon Debra Adler, 1905 Falcon Drive, Ammon Hugh Bruck, 1905 Falcon Drive, Ammon The Pledge of Allegiance to the Flag was directed by Councilman Hall, and the invocation was offered by Councilman Maeser. Jill Hobbs and Sue Gloschat represented the Parent-Teachers Association of Hillview Elementary School. When the parents, teachers, and administration meet monthly, one issue that keeps coming up is a safety problem. The concern is that children going to and from school via Williams Street do not have any designated paths or crossing areas. During busy traffic times, children are walking in the street, walking on both sides of the street, zig-zagging in and out of traffic on their bikes, and crossing wherever. The PTA has considered various ideas for the safety of the children such as designating crosswalks, establishing walking and/or bike paths, crossing guards, a flashing light, or a three-way stop for vehicles coming on to Williams Street. Mrs. Hobbs and Mrs. Gloschat appealed to the City Officials to help get the children off the street and into a safer traffic pattern. The PTA is prepared to educate the children and to help with enforcement. The City Council agreed to paint some designated crosswalks and add some "crossing" signs before school begins next fall. Following this action, the issue should be evaluated again. Patricia Bird, 3260 Western Avenue, requested a home occupation permit for a home business to finish and sell ceramic products. This will be a wholesale operation, and there will be no retail sales. The ceramics will be shipped out or hand delivered, and no one will be coming to the home. Mrs. Bird plans to buy the greenware, to paint it, and to fire it in a kiln. There will be no employees, no outside storage, and less than 25% of the home will be used for the business. Councilman Maeser moved to approve a home occupation permit for Patricia Bird, dba Cuie Creations, 3260 Western Avenue. The motion was seconded by Councilman Crandall. Roll call vote: Maeser -Yes; Crandall - Yes; Hall - Yes; Loveland - Yes. The motion carried unanimously. Kathy Dansie reported for the Planning and Zoning Commission. Robert Carter has been on the agenda for two meetings, but he has not attended either meeting to present his plans for a commercial development on Lots 1, 2, 3, 4, and 5 of Block 1 of the Chambers Addition. No action has been taken. Plans were presented to the Planning and Zoning Commission for Rex's Video and Appliance Center to be located east and north of the three houses at 2965, 2975, and 2985 East 17th Street. Phase I of the plans proposes a retail store of 15,000 square feet. Phase II is for a distribution center of 99,997 square feet. Phase III is a warehouse of 117,360 square feet. At this time, the developer proposes to build the retail store on the East 17th Street frontage now zoned C-l. Phase II and Phase III will be scheduled later. Engineer Benton oriented the Council to the plans which were presented at the planning and zoning meeting. The developer is from out of state, plans are to purchase the property from Grobergs, and Benton Engineering has prepared a topographic map of the property. The Planning and Zoning Commission did not have a problem with Phase I of the development. However, they questioned warehousing and recommended the developer apply for a zone change from C-l to GC-l for the property involved in Phase II and Phase III. The City Council did not for see a problem with the retail store, but they too expressed concern about warehousing. A major concern of City Council was the amount and kind of traffic generated by a warehouse operation. The Planning and Zoning Commission emphasized that the developer should understand there is a problem with the Phase II and Phase III stages of the development before they begin the project. Also, a request for rezone to GC-l should be carefully considered because the GC-l zone will allow uses not suitable for East 17th Street. 207 May 4, 1995 Mrs. Dansie reported that the Planning and Zoning Commission is concerned about the condition of the log house property at 2865 South Ammon Road, and they want to know if a construction time limit was designated. The City Council minutes of August 6, 1992, indicated the owners were preparing to move into the daylight basement before winter and they estimated it would take a year to complete the upper story. There has been considerable citizen complaint about the condition of the property. The owners should be encouraged to speed up construction, and Councilman Hall agreed to contact them. Idaho Traffic Safety, 3400 East Sunnyside Road, needs to be reminded the C-l zone does not allow outside storage of merchandise, equipment or other materials. Their present operation violates this zoning requirement, and they were just granted a rezone to C-l for additional property to expand their business. The City Office was requested to send a letter to Rich Hardy to remind him of the requirements of the C-l zone. A copy of City Code Title XI, Chapter 18 should accompany the letter. The motion was seconded by Councilman Hall. Roll call vote: Maeser- Yes; Hall - Yes; Loveland - Yes; Crandall - Yes. The motion carried unanimously. The City Council discussed the problem with the fence at 3225 Circle S Drive which prevents a clear view of the intersecting street and causes a traffic hazard at Midway Avenue and Circle S Drive. Attorney Anderson advised whereas the property owner got a variance from the City when he built the fence, it does not give him the right to build beyond his own land. The fence is built on the City's right-of- way reserved for a sidewalk. The right-of-way cannot be acquired by use from a municipality or a governmental unit. Options for consideration are eliminating the fence, moving the fence back from the curb to the owner's property line, or withdrawing the variance. It was questioned whether the variance allowed a six- foot high fence or whether it concerned where it could be placed. Attorney Anderson read from the City Council minutes of April 3, 1980, when the variance was granted. It was determined that the City Council has an obligation to take action I because citizens have pressed the issue. Attorney Anderson was authorized to write a letter to Gene Killian, 3225 Circle S Drive, to indicate there is a liability and propose his fence be moved back to the property line. The variance for a six-foot high fence will still be honored, and the City is willing to participate in the correction. Development of a portion of the Suitter property by Dr. Stephen Marano is proceeding but the problem of extending the City water and sewer lines to that area has not been resolved. The annexation agreement entered into with the original owners and the City of Ammon applies to any development and the new owners need to comply. The City Office was instructed to write a letter to Dr. Marano to request him to meet with the City Council to discuss his plans and work out a satisfactory agreement. The letter should state that the City of Ammon has not granted permission for a private well or septic tank. Kathy Dansie advised the Planning and Zoning Commission recommended that the access from First Street to the day-care school should be limited to the one building until the property is platted. No up-to-date information was available on the new City Building plans. There was discussion about whether or not to have a window between the Council room and the entry hall to utilize the hall for an overflow crowd. The Council authorized the City Office to notify the architects to eliminate the window. The architects are working on the details of the reception area and should have some plans for the next City Council meeting. Councilman Maeser discussed the request of Scott Gray for a refund on his building permit fee for Soapy's Car Wash. The computation of the permit fee was reviewed with the Bonneville County Planning department item by item. It was interpreted that the fees were figured accurately and no refund is in order. The Council agreed with the interpretation. I Ammon Spring Clean-Up Day is on schedule for Saturday, May 13, 1995. David Gonzales, 2420 South Ammon Road, requested assistance in working out his plans to add a storage garage so the building will conform with the zoning laws. The City employees agreed to help Mr. Gonzales with his plans. Reports: David Wadsworth reported for Public Works. Mayor Ard asked how the Jones drainage project is progressing. Street pothole problems were discussed. Public Works Director David Wadsworth has been working with H-K on water and sewer lines for the Ammon Town Center project. Robert Farrow reported the Fire Department will be participating in the Emergency Fair later in May. Six volunteers plan to attend fire school on June 17, 18, and 19 in Twin Falls. Fire hydrant testing begins May 6. Councilman Loveland reported on the parks. added around them. Also, some of them need working on the layout for the walking path. This is the same as last year. Debra Alder and Hugh Bruck, 1905 Falcon Drive, complained about three problems. The noise from Ammon Town Center construction is driving them "nuts". Potholes on Falcon Drive have been filled up with gravel for months and months. Vehicles park on the sidewalks so when Ms. Alder pushes her baby down the street in the stroller she has to go out into the traffic. There is no way to resolve the noise problem from the Ammon Town Center construction. However, when the fence is constructed and the canal is finished, the noise should be reduced. These are scheduled to be completed by June 1. Potholes will be taken care of when the weather is warmer and patching materials are available. Controlling parking on Falcon Drive has been a problem. Street parking in the Hillview/Hillsdale area was discussed. The City Council agreed to have the area patrolled and to issue warning tickets. The warning tickets will be followed up with parking tickets. Claims were approved. Councilman Crandall moved to adjourn the meeting, and the motion was seconded by Councilman Hall.
