Whiteley Others present during the meeting were Wm. Max Brinton, County Zoning Administrator, and Bill Manwill of the County Engineer's OfficeJ Cynthia Pulley, Vaughn Wadsworth, and R. G. Stedtfeld. The pledge of allegiance to the flag was conducted by Councilman Lee; the invocation was by Mayor Wehmann. Minutes of the regular meeting of July 5, 1978, were approved as prepared. Just prior to this meeting an information discussion was held with the Bonneville County Fire Protection District No.1 Commissioners Dale Rockwood, Everett Seyfert, and Don Gosswiller, and Fire Chief Doug Call in relation to a letter from the Fire District dated June 23, 1978, which gave notice of the intention to terminate the Mutual Aid Agreement. The Fire District officials explained that it was not intended that the letter should go to the news media before being received by the City of Ammon and apologized Ior that situation. Items which were brought up for discussion included the terms of the agreements on mutual aid and the housing of a District tanker truck in Ammon, the number and quality of responses under the Mutual Aid Agreement, the assessed valuation and tax base of the two entities as related to growth in the area, the possi- bility of a joint facility in the future, and the need for uniform training if mutual aid is to continue. It was noted that the City is now in the process of a training program for the Volunteer Fire Department and would be willing to signa revised Mutual Aid Agree- ment with a provision added relating to training. In response to a question by Commis- sioner Seyfert about what he called "excessive" amounts paid to the City for heating the building where a District truck has been stored, Mayor Wehmann gave assurance that an adjustment would be made if there were errors in the billing. The meeting concluded with expressions of appreciation for being able to get together and talk over matters of con- cern, and Mayor Wehmann asked that the Fire District officials make contact with the City as soon as any decisions are made. The regular meeting opened as a continuation of the Public Hearing on the proposed annexation and zoning of the West Ammon Estates subdivision. David Benton, representing the developers, Randy Waite and Larry Felt, displayed a revised preliminary plat as re- quested when the hearing was recessed on May 18, 1978, and called attention to the pro- visions on the plat for l20'x165' lots on the property adjoining the west boundary of the Original Townsite and for the extension of Molen Street through into the proposed subdivision. He noted, also, that the street layout had been changed to give flexibility to the development of the Derrald Ricks land in the future and that curb and gutter is planned for the subd_ivision but the street on the east could be left as a rural type if desired since the lot frontage on both sides of the street is 120 feet. It was acknow- leged that Mrs. Pulley, 2800 Western Ave., was the only interested property owner pre- sent, and she commented that the change to provide for larger lots along the east side of the plat as mentioned eliminates the cause for objection which was voiced by her and her husband previously. In answer to her question about having animal overlay on the larger lots to match those adjoining them in the Original Townsite, it was explained that this had not been discussed with the developer, and that the lack of the overlay zone in the new subdivision could not affect having livestock animals on the Pulley property. The City Clerk reported that Derrald Ricks had been in earlier during the day to view the revised plat and had indicated no objection to the street layout as now proposed. The location of the area designated as Division No.1 on the plat, which the developers request to be annexed first, was discussed, and the Mayor and Council members recommended that this division be revised to include lots that would give access from the east side of the Ammon Townsite, not only for fire protection but for children getting to school. Councilwoman Dille moved to accept the preliminary plat of West Ammon Estates (with zoning of R-l) as presented, but that it go back to the developer to consider opening up an access into the Original Townsite at ei ther Owen Street or Molen Street in Division No.1 before annexation is approved. The motion was seconded by Councilman Lee; voting was all in favor; motion carried. July 19, 1978 56 Vaughn Wadsworth, 3840 Sunnyside Road, and R. G. Stedtfeld, 3795 Sunnyside Road, appeared to inquire about the hearing on a zone change from R-l "to R-2A requested by Theron Beck and neighbors which was held before the Planning and Zoning Commission the previous evening. Some background information on the subject was reviewed, and reference was made to a memo stating that the Planning Board recommends the zoning change. A hearing before the City Council was set for September 6, 1978, and Councilwoman Dille and Councilman Rowberry were appointed to investigate the matter in connection with parking spaces, etc., since the property owners propose to remodel single-family homes into duplexes if the zoning is changed on their lots on the north side of Sunnyside Road east of Ross Avenue. In response to a question by Mr. Wadsworth concerning the future widenin& of Sunnyside I Road, Bill Manwill of the County Engineer's office stated that the plans have not changed from the original recommendation of 114 feet of right-of-way to Hitt-Hackman Road then 90 feet from there to the east except for far enough to transition. Mayor Wehmann requested that the record sho>> that the City of Ammon is opposed to any wider right-of-way on Sunnyside Road east of Hitt-Hackman Road greater than 90 feet. Wm. Max Brinton and Bill Manwill, representing Bonneville County, displayed a Flood Plain map prepared by HUD, and gave instructions that any requested changes are to be documented and submitted within two weeks. Councilman Swensen and Councilman Lee were assigned to make a survey and a recommendation so that a letter can be written. It was noted that any building done in the flood plain area as finally approved will be subject to certain regulations and must have flood insurance. Mayor Wehmann mentioned that Attorney Anderson has received a letter from the County Zoning Administrator indicating that the County Commissioners are in accordance with the Impact Area as recommended, and will be taking action on this subject shortly. It was noted that the Impact Area Ordinance (No. 155) which had been voted upon on January 18, 1978, was never published and made official. A new Impact Area Ordinance was presented for consideration, and was assigned Ordinance No. 165. The ordinance was read by title, and Councilwoman Dille moved to dispense with the rule requiring the reading of the ordinance on three different days and that the three readings be waived. The motion was seconded by Councilman Swensen; voting was Dille, yes; Swensen, yes; Lee, yes; motion carried. Ordinance No. 165 was again read by title and in full. Councilwoman Dille moved and Councilman Swensen seconded that Ordinance No. 165 be adopted as an ordinance of the City of Ammon on its third and final reading. Voting I was Dille, yes; Swensen, yes; Lee, yes; motion carried; Ordinance No. 165 adopted. Councilwoman Dille moved and Councilman Swensen seconded that Mayor Wehmann be author- ized to sign an Impact Area Agreement with the County Commissioners for and in behalf of the City of Ammon; voting was all in favor; motion carried. Regarding a suggestion which was made at the previous meeting that the speed limit be reduced on 17th Street, Councilwoman Dille reported t@at the County Traffic Safety Committee felt that this was not practical and woulSYtoodifficult to patrol. Council man Swensen recommended that a request be made for a stop light or other suitable traffic control at Sunnyside Road and Yellowstone Highway. Copies of a budget procedure schedule which would complete the necessary hearings and have a budget ready to adopt on August 23, 1978, were distributed by Mayor Wehmann, who noted that he will have preliminary proposed figures ready for review next week. With reference to the summer watering regulations, Mayor Wehmann announced that the official proclamation as approved and published on May 9, 1978, is to be printed in the newspaper again, then speqial patrolling to issue tickets to violators will get under way. He explained that this is felt to be advisable in view of the high cost for power to pump water and considering that many violations of the rules have been observed. The Mayor stated that he would like to see the penalty for failure to obey watering re- gulations changed to $7.50 for the first offense, $25.00 for the second offense, and the installation of a water meter required for the third offense. A drawing and appraisals of the Mel Brown well area were reviewed, and Engineer Benton I was asked to make some calculations and a recommendation at the next meeting about how much land would be needed for access and efficient use of the existing building on the property before any further consideration is given to making a purchase. Council members indicated approval of arrangements to meet with Phil Choate of the East Central Idaho Planning and Development Association on August 3 to have informa- tion presented on a special program on community energy for which Ammon has been designated, as a participant, along with the Cities of Idaho Falls and Rexburg. Other matters brought to the attention of the Council by Mayor Wehmann were the intention to look at surplus Highway Department equipment with the possibility of buying a 4-wheel- drive pickup; a reminder that he and Councilwoman Dille would be attending an information hearing on the powerline loop being held by the City of Idaho Falls on July 27; the need to establish a rate schedule for water on meters and dumpster garbage collection; the July 19, 1978 fact that a mailgram was sent to the Census Bureau to start the action on a request ~~ to have a special census taken this fall, and a report that he had been in attendanc~ 4 at the ribbon-cutting for the new nursing home (Valley Care Center) on Saturday, July 15. It was reported by Councilwoman Dille that the Planning and Zoning Commission meeting has been changed to the second Tuesday instead of the third Tuesday. With reference to the vandalism on Geneva Drive and Vau~hn Street which was brought to the attention of the Council at the last meeting, C0uncilwoman Dille explained that she had checked the re- cords at the Sheriff's office and didnot find any calls on file regarding this matter, so she agreed to prepare a leiter to be sent to the residents involved. It was moved by Councilwoman Dille that the City of Ammon use the firm of David Van Weaver Associates for the design of the BOR grant construction documents and everything that is necessary to get the improvements in the parks under construction. Joe Anderson Director of Public Works Hayse L.Whiteley I Mayor Wehmann opened the meeting as a Public Hearing for the purpose of considering an amendment to the City Zoning Ordinance by the addition of a Professional Business (PB) Zone, as advertised in the newspaper. He explained that the Planning and Zoning Commission h'8'lda hearing on this subject (on June 20, 1978) with a recommendation that the Council proceed with action as needed to consider the desirability of having a separate and dis- tinct zone for professional buildings which are now zoned in multi-family residential zones. It was noted that there was no public present to make comment. Mayor Wehmann suggested that Attorney Anderson find out how the PB Zone Ordinance is working for the City of Idaho Falls. Councilwoman Dille moved to close the PB Zone hearing; the motion was seconded by Councilman Swensen; voting was all in favor; motion carried.
