Swensen, with the following City Officials present: Councilman Russell N. Swensen Clerk Deon Hemingway Councilwoman Carol A. Dille Asst. Attorney Douglas Nelson Councilman Francis Lee Engineer David E. Benton Councilman David Rowberry Auditor Walter Clapp Absent: Mayor George Wehmann The pledge of allegiance to the flag was conducted by Councilman Swensen; the invocation was offered Qy Councilwoman Dille. The minutes of the meeting on December 20, 1978, were approved as prepareq... Copies of the Fiscal Year 1978 Audit Report were distributed and a basic review was given by Walter Clapp. A date for making a detailed presentation on the audit will be set when arrangements can be made through Mayor Wehmann. An application for a non-commercial kennel license submitted by Dennis Austad, 3655 Wanda Street, was considered and found to be in order with the necessary signatures of neighboring property owners. Councilwoman Dille moved to approve the application of Dennis Austad as presented. The motion was seconded by Councilman Lee; voting was all in favor; motion carried. Recent developments were reviewed in the matter of the 161 KV powerline loop planned by the City of Idaho Falls, part of which is proposed to be constructed along the Union Pacific Railroad on the east side of Ammon. It was noted that a formal temporary re- straining order had been obtained to stop the City of Idaho Falls when construction was started on a transmission pole base inside the City of Ammon on Thursday, December 28, 1978, with the complaint charging that Idaho Falls failed to obtain a building permit as required by Ammon zoning ordinance and by Idaho Code, that construction of the lines constitutes a non-conforming use within Ammon City limits, and that Idaho Falls did not obtain a utility transmission corridor showing the location of its proposed power lines through Ammon's Area of Impact in violation of the 1975 Land Use Planning Act. Further noted was that Seventh District Court Judge Boyd Thomas and Judge H. Reynold George had disqualified themselves from the case because they are Bonneville County residents and the case has been assigned to Judge Willard Burton, Rexburg, who will probably hear the case after mid-February. In accordance with a written recommendation left by Mayor Wehmann, Councilwoman Dille moved that the City Attorney be authorized to pursue the City of Ammon's objections to the Idaho Falls 161 KV powerline and that Councilman Rowberry be disignated to represent the Mayor and City Council to work with the Attorney, with Councilwoman Dille assisting as needed. The motion was seconded by Councilman Rowberry; voting was all in favor; motion carried. As a matter of interest on this subject, reference was made to a copy of a letter from the County Prosecuting Attorney to the County Zoning Administrator giving legal counsel regarding utility transmission corridors not having been provided jor in the County Comprehensive Plan. A suggestion made by Mayor Wehmann that the City apply for funds through the Rural Community Fire Protection Program to use for building a new fire station, on the property north of 17th Street which the City is purchasing, was brought up by Councilan Swensen. The Council members indicated approval, and it was noted that Engineer Benton is working up some costs so the application can be submitted by the January 15th cut-off date. A list of water, sewer, and garbage rates, as calculated and proposed by Mayor Wehmann and Councilman Rowberry, were reviewed. Items discussed included the amount for water per basin in barber and beauty shops, whether the rate for churches should be per building or per congregation, and the charge for schools. The Council members agreed to study the proposed rate schedule for action at a future meeting. Councilman Lee mentioned that the annual Fire Department report for 1978 shows 73 re- sponses to calls from the Fire District and 22 calls in the City, with no assistance called for from the District on fires in Ammon. The Law Enforcement report for the month of November was also reviewed by Councilman Lee. A report by Councilman Rowberry indicated that he had contacted Doyle Jones of the Servisoft Water Conditioning business at 3250 E. 17th Street regarding hooking up the sewer line there, as discussed at the previous meeting. Councilman Rowberry pointed out that there are some questions about the L.I.D. #8 assessments on the Servisoft property, and Engineer Benton was asked to explain the situation to Mr. Jones prior to the Assess- ment Roll Hearing, which is set for 7:30 P.M., Tuesday, January 9, 1979 Engineer Benton delivered duplicate copies of development drawings for Meadow Lark Es- tates, Division No.2, for the City records, and advised that the original signed copies are on file in his office. He presented Payment Request No.2 on L.I.D. #8 work from January 4, 1979; Jan. 9, 1979; Jan. 18, 1979 o ~~ Construction in the amount of $10,040.85. Councilwoman Dille moved that Mayor Wehmann be authorized to call for an interim warrant to obtain funds to make payment on the request as submitted. The motion was seconded by Councilman Lee; voting was Dille, yes; Lee, yes; Rowberry, yes; motion carried. Engineer Benton offered to check with Bill Manwill of the County Engineer's office regarding a letter stating that the City of Ammon is to pay the State Highway Department $30,822.55 for Ammon's share of the final audited costs on the 17th Street Improvement Project which was completed in 1976. Claims in the amount of $3.427.73 were presented for payment by the City Clerk and approved by the Council. Benton I The pledge of allegiance to the flag was conducted by Mayor Wehmann and the invocation was offered by Councilman Swensen. Minutes of the meeting on January 4, 1979, were approved as prepared. It was noted that the opening of the regular meeting had been delayed for the completion of the L.I.D. #8 Assessment Roll Hearing, that action had been taken at that meeting on the objection submitted by Michael Jones representing Poole Softwater (Servisoft), and that Ordinance No. 173 confirming the assessment roll for Local Improvement District Nu. 8 was adopted. Present at this meeting, in addition to the City Officials, were Michael Jones and Scout leader Glenn Smith with several Boy Scouts. Inasmuch as Ron Parish, Consolidated Agencies, did not appear as planned to present in- formation on a proposal for supplementary disability insurance on the volunteer firemen, Councilman Lee listed a quotation given to him by Mr. Parish, which was somewhat less than the premium requested by the present carrier, and it was recommended by the Council that coverage by Consolidated Agencies be accepted and that action be taken when the policy is delivered. In connection with insurance, Mayor Wehmann mentioned that cover- age can be obtained on the well pumps and motors but more information is needed before considering this. Regarding final costs on the 17th Street Project which was brought to the attention of the Council at the previous meeting, Engineer Benton stated that the calculations were on items not paid for before according to the records at the County Engineer's office. No action was taken on a proposal, received from the County Commissioners through County Engineer Bob Gray, that Ammon's share of the billing ($30,822.55) be paid at this time by the County under an agreement with Ammon that reimbursement be made as funds are available, but Mayor Wehmann indicated that he would correspond with the Commissioners on this matter. A questionnaire sent out by the Association of Idaho Cities on legislative matters which are likely to be considered in the current session of the Legislature was re- viewed briefly,and the Mayor and Council members indicated that they would complete the papers and return them to the City office for mailing.
