Council Minutes 11/01/1979 November 1, 1979 122 CITY OF AMMON November 1, 1979 Minutes of the Regular Meeting of the Mayor and City Council: The meeting was called to order at 7:30 P.M. by Mayor George Wehmann, with the following City Officials present: Mayor George Wehmann Councilman Russell N. Swensen Councilwoman Carol A. Dille Councilman Francis Lee Councilman David Rowberry Clerk Deon Hemingway Public Works Director Hayse L. Asst. Attorney Douglas Nelson Engineer David Benton Whiteley Others present during.the meeting were Doug Brinkman, Levi Clements, and Dorotpy Clements. The pledge lof allegiance to the flag was conducted by Councilman Lee and the invocation I was offered by Councilman Swensen. It being the advertised time and place, the meeting was opened as a public hearing on a request for a re-zone from R-l to R-3A on a small portion of the southwest corner of Tie Breaker Village Subdivision lying south of John Adams Parkway. It was noted that no in- terested people representing the. public were present, that the requested R-3A ~oning was compatible with that recently approved on adjacent land in the Paul Benton Property, and that the Planning and Zoning Commission unanimously recommended approval on the request presented by Russ Wallace, the property owner. The hearing was closed at 7:40 P.M. Councilwoman Swensen moved to grant the Russ Wallace request for a zone change from R-l to R-JA on that portion of Tie Breaker Village Subdivision as advertised and presented. The motion was seconded by Councilwoman Dille; voting was unanimous in favor; motion carried. Volunteer Fireman Doug Brinkman, 2840 Teton Street, was given time to present information on a proposed questionnaire program which would acquire pertinent information from indi- vidual homes relative to fire protection. He mentioned that insurance agents have offered to provide stickers to be placed on windows of homes where there are small children or invalids, and listed other benefits which would result from the information to be obtained. According to Mr. Brinkman, the Fire Chief has approved the program, and the endorsement of the City Officials is desired. The Mayor and Council members agreed that the idea was commendable, and Councilman Rowberry moved to give official endorsement to the proposed fire-protection information project as requested by the Volunteer Fire Department and to make the records in the City Office available for obtaining addresses for the distribu- tion of the questionnaires. The motion was seconded by Councilman Swensen; voting was all in favor; motion carried. The subject of a variance for Levi Clements, 3060 Rawson Street, as presented at the previous meeting, was brought up for discussion. Mr. Clements reported that he did not get a survey made but had determined from the county records that his property is 85 feet wide. Hayse Whiteley, City Building Inspector, explained that, using the swing points provided by the City Engineer, he had found that the City right-of-way along Western Avenue comes to 10 feet west of the ditch, which would put the property line very close to where the foundation for the garage has been placed. An appointment was made for Mr. Whiteley to meet with Mr. Clements to take some measurements so that the lot line can be located to the satisfaction of Mr. Clements before the matter is dis- cussed further. I An application for a non-commercial kennel license submitted by Lewis Simcask, 3040 Rawson Street, was presented for action and found to be in order with the necessary approval signatures having been obtained. Councilman Lee moved and Councilman Swensen seconded that a non-commercial kennel license be granted to Lewis Simcask as requested. Voting was all in favor; motion carried. Mayor Wehmann reported that a City truck was involved in an accident while being driven by the Animal Control Officer, and repairs will be paid for by the insurance of the ~iver of the. other car who was at fault in the accident. He mentioned that the City wlll be applYlng for grant funds to pay the expenses of intervening in the present UP&L rate-increase case. The proposed increase in valuation on City properties for insurance coverage was brought up by Mayor Wehrnann, and the Council indicated approval of the re- commendation as made in the meeting on October 18, 1979. According to Public Works I Director Hayse Whiteley, an opportunity has corne up to sell the large snow plow for $2,575, and Council approval was given on this. It was suggested that Mr. Whiteley look for a snow plow which can be mounted on the 4x4 pickup truck. During the re- mainder of the meeting, the law enforcement report for October and the activities of the Animal Control Officer were reviewed, Attorney Anderson reported on his progress in preparing a new dog ordinance, Mr. Whiteley explained problems involved in repairing a leak in the waterline near the 17th Street storm sewer pump station and reported that Well #7 has been shut down for winter, and Mayor Wehmann pointed out the need to have a "call forwarding" system added to the City Office telephones so there will be 24-hour and weekend coverage for emergencies. Claims were approved for payment in the amount of $7,830.78. It was moved by Councilman Swensen and seconded by Councilman Rowberry with voting all in favor, that the meeting adjourn; time 9:35 P.M.
