Sw'ensen with the following City Officials present: Acting Mayor Russell N. Sw'ensen Councilwoman Carol A. Dille City Clerk Deon Hemingway Public Works Director Hayse L. Whiteley Engineer David E. Benton Planning Commission Member Michael Browning Absent: Mayor George Wehmann Councilman Thayle D. Monson Councilman Robert D. Williamson The pledge of allegiance to the flag was directed by Acting Mayor Swensen and the in- vocation was offered by Councilwoman Dille. Resident Dick Bybee was also present. The meeting was opened as unofficial because of the lack of a quorum. Details were reviewed concerning driveway damage at the Dick Bybee residence, 21JO Ross Avenue, which was reported at the meeting on April 7, 1983. It was noted that the adjuster for the City's liability insurance has sent notice that the claim for insurance settlement has been denied since the damage that was done is on the City right-of-way. Public Works Director, Hayse Whiteley, indicated that the City should take care of the problem but probably with asphalt instead of concrete. A decision is to be made at the meeting on July 7. Another matter which was discussed was with regard to the odor problem and the amount of suspended solids in the sewage flow at the Sunnyside Potato Company. Engineer Benton pointed out that a representative of the State Health Department Environment Division has checked on the situation and that the potato plant man~er must be given notice to take action immediately to correct the problem. Claims to pay in the amount of $19,972.86 were approved along with vouchers for payroll and related expenses paid since the previous meeting totaling $13,523.51. Williamson L. Whiteley The pledge of allegiance to the flag was directed qy Councilman Monson and prayer was offered by Councilman Swensen. As a matter of record, Mayor Wehmann noted that prior to the opening of the meeting, which was delayed because of a quorum not being present, Norma Brown of 1750 Falcon Drive appeared and made a request that the cement pipe playground equipment on the property known as Falcon Park be moved back or taken out completely, stating that it is unsightly and objectionable to the neighborhood. No action was taken on this on the basis that Councilwoman Dille was not present, and she was involved in the original placement of the pipe as a Boy Scout project. There was further discussion on the driveway repair at the Dick Bybee residence, 2130 Ross Avenue, with emphasis on the City standard requiring that asphalt, rather than cement, be used in the City right-of-way for driveway entrances in non-curb-and-gutter areas. Attorney Anderson mentioned that there has been an inquiry about getting a liquor-qy- the-drink license. He indicated that he would review' the law to determine if the City must adopt an ordinance on this subject before an applicant can obtain a license. Etsel Sommer of JJ20 Molen street came in with a complaint about a dog which is allow'ad to run loose and jumped on his grandchild causing an injury. Prompt City response to this complaint was assured. MayorWehmann called attention to the fact that the time is approaching for getting the Fiscal Year 1984 budget prepared. July 7, 1983 July 21, 198J 240 Councilman SWBnsen was thanked by Mayor Wehmann for performing the duties of Acting Mayor during the several months that he was on leave of absence. The City Clerk presented claims to pay in the amount of $10,742.07 and claims already paid for payroll, etc., totaling $..5,..560.17, all of which were approved. The pledge of allegiance to the flag was directed by Councilman SWBnsen and the invo- cation was offered by Councilman Williamson. Minutes of the meetings on May 5, 198], May 19, 1983, June 2, 1983, and June 23, 198], were approved as prepared. City Clerk Dean Hemingway Public Works Director Hayse L. Whiteley Engineer David E. Benton Ordinance No. 194 was introduced and read Qy title: AN ORDINANCE PROVIDING FOR THE CHANGE OF ZONING OF PROPERTY DESCRIBED HEREIN; PROVIDING FOR THE AMENDMENT TO THE ZONING MAP OF THE CITY OF I AMMON; DETERMINING THE PROPER ZONE FOR THE CLASSIFICATION OF THE PRO- PERTY DESCRIBED UNDER THE ZONING ORDINANCE OF THE CITY OF AMMON AND PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE. Councilwoman Dille moved that the City Council dispense with the ruling which requires the reading of the ordinance on three different days and that the ordinance be placed on its third and final reading. The motion was seconded by Councilman Swensen; voting was Dille yes, SWBnsen yes, Williamson yes, Monson yes; motion carried. Ordinance No. 194 was read in full. It was moved by Councilwoman Dille and seconded by Council- man Monson that Ordinance No. 194 be adopted on its third and final reading. Voting on the motion was Dille yes, Monson yes, Swensen yes, Williamson yes; motion carried and Ordinance No. 194 adopted. Continuation of a special use permit for Judy's Ida-Man Ranches at 3070 Sunnyside Road allowing storage graineries on residential property was reviewed as required Qy the conditions of the granting of the permit on June 4, 1981. It was moved Qy Council- man Monson and seconded by Councilw'oman Dille to approve an extension of the special use permit as recommended by the Planning and Zoning Commission. Voting on the motion was Monson yes, Dille yes, Swensen yes, Williamson yes; motion carried. Mayor Wehmann mentioned the need to give notice to property owners about weed problems that are fire hazards and to residents about taking more care in the use of dumpsters to help eliminate odors and flies. He also reported on a call from Keith Brown, 19..5..5 Ross Avenue, regarding the baseball diamond in Peterson Park. In connection with the driveway damage at the Dick Bybee residence, 21]0 Ross Avenue, which was discussed at previous meetings, the Council indicated agreement with the recommendation made by Mayor Wehmann that, if Mr. Bybee wants to remove the cement back to the crack, the City will move the cement and fill in with gravel, then Mr. Bybee can put in asphalt, with no money outlay by the City. I A report given by the swimming pool manager, Blair Thomas, indicated that the fi- nancial situation for the pool looks better this year, probably due to decisions that were made to open later, which has saved on heating costs, and to have the manager also be the lesson supervisor, which has saved on salary expenses. In response to a question about opening on Sundays, it was pointed out that the pool needs the rest- ing day to get filtered good and ready for the next week. Councilwoman Dille noted that she had talked to Mrs. Norma Brown of 1750 Falcon Drive regarding her complaint about the cement pipe in Falcon Park and learned that the City does not own the park, which she said she was not aw'are of previously.
