CHAPTER 09 Title 9 Snow Removal CHAPTER 9 SNOW REMOVAL SECTION: 9-9-1 Purpose 9-9-2 Definitions 9-9-3 Snow Removal Proclamation 9-9-4 Parking Restrictions 9-9-5 Other Parking Restrictions 9-9-6 Removal of Vehicles 9-9-7 Payment of Towing and Storage Fees 9-9-8 Placing Snow in Public Right of Ways 9-9-9 Duty of Property Owners 9-9-10: Violations and Penalties 9-9-1: PURPOSE: The City Council does hereby determine and declare that this ordinance is necessary and desirable for the following purposes: (A) To render the removal of snow and ice from the public streets safe, more economical and efficient. (B) To avoid collisions of snow removal equipment with motor vehicles, motorcycles, trailers, equipment. (C) To reduce the possibility of accidents involving pedestrians. 9-9-2: DEFINITIONS: The following terms shall have the meaning as herein specified: MOTOR VEHICLE: Every self-propelled vehicle in, upon, or by which any person or property is or may be transported or drawn upon a public street or highway except vehicles or devices used exclusively upon stationary rails or tracks. MOTORCYCLE: A motor vehicle having a seat or saddle for the use of the rider and designed to travel on not more than three wheels in contact with the ground. TRAILER: Every vehicle without self-propelled motive power designed to carry persons or property and which is drawn or propelled by other motive power. EQUIPMENT: Any property which is stored or maintained upon a public street of the City of Ammon. 9-9-3: SNOW REMOVAL PROCLAMATION: In preparation or in response to seasonal snow events, the City Council may issue a Snow Removal Resolution, also known as a Snow Removal Proclamation. The Snow Removal Resolution shall set forth snow removal policies, parking restrictions, public noticing requirements, and shall state the specific date and time when the restrictions shall go into effect. Further the City, and its agents, shall be authorized to take all such actions, including but not limited to the removal of vehicles, Title 9, Chapter 9 Page 1 of 3 Revised 12-07-2023 towing of vehicles and the issuing of citations for violations of any Snow Removal Resolution etc., as provided for in said resolution. All penalties provided for in the Snow Removal Resolution shall be a civil penalty, a parking infraction and/or an infraction as provided for in the Ammon City Code at the determination of the enforcement officer or their designee. 9-9-4: PARKING RESTRICTIONS: No person shall stop, stand, or park a motor vehicle, motorcycle, trailer, or equipment on the streets of the City when: A. A snow proclamation has been issued in accordance with section 9-9-3 or B. At times of heavy snowfall or C. At other times as deemed necessary by the Mayor, Council President, or in their absence the City Administrator. 9-9-5: OTHER PARKING RESTRICTIONS: In the event any other ordinance, statute, or regulation provides for parking restrictions which are more restrictive than those set forth herein then such other parking restrictions shall be controlling and may be enforced in accordance with the terms of such other ordinance, statute, or regulation. 9-9-6: REMOVAL OF VEHICLES: Any motor vehicle, motorcycle, trailer, or equipment parked upon any public street in violation of this ordinance or in violation of the Snow Removal Resolution may be ordered to be removed at any time at the direction of the Enforcement Officer or their appointed designee working in conjunction with the designated law enforcement agency to the City of Ammon and may be towed to another public street that does not violate the provisions of this or any other provisions of this Code. The vehicle may also be towed and stored in any public or private storage lot without prior notice to the owner or operator of the vehicle. 9-9-7: PAYMENT OF TOWING AND STORAGE FEES: The owner or operator of any motor vehicle, motorcycle, trailer, or equipment towed, removed, or stored pursuant to the preceding section shall be responsible for all reasonable towing, removal, and storage charges of the private towing company. Such charges shall be paid to the private towing company before the vehicle, motorcycle, trailer, or equipment is released. 9-9-8: PLACING SNOW IN PUBLIC RIGHT OF WAYS: It shall be unlawful for any person to move, place or deposit snow from private property onto or across the road right of ways within the City. 9-9-9: DUTY OF PROPERTY OWNERS: A. Removal of Snow from Sidewalk, Curb, and Gutter. Owner, agent, or lessee of real property shall remove any snow, ice, and other obstruction or dangerous condition upon any sidewalk, curb, and gutter abutting his or her property within 72 hours of occurrence. B. Civil Remedy to Abate. If the owner, agent, or lessee of real property fails to remove any snow, ice, and other obstructions as required by this title, the City Enforcement Officer may notify the owner or person in control of property to remove the snow, ice, or other obstructions. Title 9, Chapter 9 Page 2 of 3 Revised 12-07-2023 C. Failure to Remove Snow, Ice, and Obstructions. If the owner or person in control of such premises fails to comply with the notice issued by the City Enforcement Office, the City shall have the right, but not the obligation, to remove the snow, ice, and other obstructions from the property at the expense of the owner or person in control of the premises. The cost to remove the snow, ice, and other obstructions, plus 10 ten percent for administrative purposes, shall be billed to the owner or person in control of the premises. 9-9-10: VIOLATIONS AND PENALTIES: Any violation of the provisions of this chapter shall be deemed an infraction and shall be subject to penalties prescribed for such violations under section 1-4-2 of this code. Each day such violation continues, shall be a separate violation, which shall be deemed as a separate infraction and a citation may be issued therefore. Violations shall be assessed on a per violation per day basis. At the discretion of the City of Ammon Enforcement Officer or their designee parking violations listed in Title 9, Chapter 4, Section 1 of the Ammon city Code. The City of Ammon may designate said violations to be subject to penalties and fees payable directly to the City of Ammon which shall be determined by a schedule of fees adopted by the City Council by resolution which may be amended from time to time.
