Council Minutes 04/02/1973 I o 00 l'- CO W W I I 1 CITY OF AMMON March 19, 1973 Minutes of the Regular Meeting of the Mayor and City Council: The meeting was called to order at 7: 35 P. M. by Mayor Keith C. Turnbow wi1h the following city officials present: Mayor Keith C. Turnbow Councilman Lynn C. Richardson Councilman Marvin J. Anderson Councilman Gerald B. Cheney Others present during the meeting were Boyd Thompson and Elvin Gottfredson. Clerk Deon Hemingway Attorney Franklin Smith Engineer David Benton Prayer was offered by Councilman Anderson. The minutes for the meeting of March 5, 1973 were approved as typed. The meeting was opened for a hearing of the 1973 Budget. Attorney Smith explained that a budget estimate was drawn up and approved at the last meeting, and the appropriation ordinance was ready for passage. In the absence of disapproval by anyone present, Attorney Smith read Appropriation Ordinance No. 110. Councilman Cheney moved to dispense with the second and third readings of the ordinance and to place it on the third and final reading by title only. Seconded by Councilman Richard- son; voting: Cheney, yes; Richardson, yes; Anderson, yes; motion carried. Ordinance No. 110 was read for its third and final reading by title only. Councilman Richardson moved that the Council adopt Ordinance No. 110. Seconded by Councilman Anderson; voting; Richardson, yes; Anderson, yes; Cheney, yes; motion carried. Mayor Turnbow presented a number of questions which City of Idaho Falls officials have indicated will have to be considered in coming to an agreement to contract for building inspection services, and an informal discussion was conducted to get the feeling of the council members. Attorney Smith advised that entering into such an agreement appears to be in accordance with state law, but some minor changes in the language of the proposed recodified ordinance pertaining to- building pe.rmits and. inspections might be necessary. Further checking into this matter will be done by the City Attorney, in addition to working with the Idaho Falls Attorney to determine if the agreement terms should be in the form of an ordinance or a contract. A request for a zoning change was brought up by Mr. Boyd Thompson who was advised to take his proposal to the Planning and Zoning Commission. Engineer Benton reported that a contact has been made with the Portland office of EPA, and information was given that there would be no participation by that agency in any work on the sewer project that is done before a grant offer is made. ThiS has resulted in a standstill at the pre sent time in the plans to get the lines under the creeks and canals which was approved at the last meeting. Council members were reminded to attend the public hearing on the proposed zoning ordinance and recodification of the city ordinances on Thursday, March 22, at 8:00 P. M. in the Ammon Jr. High Auditorium. Mayor Turnbow requested a change in the wording of the section pertaining to snow removal, which was taken under advisement. Councilman Richardson called attention to the problem of garbage being dumped in the pit behind the Circle K Store, and it was suggested that the Attorney write a letter to the property owner. Mention was also made of complaints received regarding incon- sistencies in issuing parking tickets. :The M. Anderson Prayer was offered by Councilman Sw~nsen. Minutes of the Meeting of March 19, 1973, were approved as typed. Councilman Richardson moved that the Council accept the zoning recommendation' of the Planning and Zoning Commission for further action by the Council, and that a zoning hearing and a recodification hearing be set for April 23, at 8 P. M., in the City Building. Seconded by Councilman Cheney; voting: Richardson, yes; Cheney, yes; Swensen, yes; Anderson, yes; motion carried. Councilman Richardson moved that the next regular meeting be deferred from April 16 to April 23; seconded by Councilman Cheney; voting all in favor; motion carried. Mr. and Mrs. Brent Elg, residents of Falcon Drive, requested action by the city to eliminate the excessive noise problem causee. by motorized vehicles in the yacant area along Sand Creek. The Attorney was asked to write to the property owner to request that the area be posted to prohibit this disturbing activity. It was also suggested that the situation could be controlled by all adjoining property owners getting together and buying the land. Mr. Elg mentioned the need for radar speed patrolling on Falcon Drive. I Mayor Turnbow presented a copy of prevailing wage rates to Engineer Benton which, by instruction of the State Labor Department, must be included by any contract$ let for the sewer construction. A review of bids received for hazard and liability insurance for the city was given by Mayor Turnbow as follows: Blackburn Insurance Co., $1504; Farmers Insurance Group, $2008; Farm Bureau Insurance, $2266. Blackburn Insurance Co. will be requested to write the policy for the coming year. Coverage has been with Famners Insurance Group for the past several years. Engineer Benton reported that Hartwell Construction Co. is installing the sewer line crossing of Sand Creek at a total cost of $4510.24, with the labor portion to be paid to Hartwell and the purchase of the pipe to be billed directly to the City by the manufacturer. This agreement was accepted over an estimate of $4975 made by the Grover Construction Co. Cooperation has been. promised through James Steele of I the irrigation district to allow sewer line crossings of the canals, etc., if possible during the irrigation season. Councilman Swensen was assigned to take care of the ditch-watering schedules for the coming summer, and it was noted that the ditche cleaning will be under the direc- tion of Maintenance Supervisor LaVern Williams. Mayor Turnbow mentioned that general clean-up projects will be conducted by the Boy Scouts on Saturday, April 21. Concerning the landscaping project for McCowin Park, Mr. Stone has picked up the list of trees and shrubs offered for donation to check on theJ:ll, and Councilman Cheney will follow through on the progress of the plans. I o 00 ~ CO W W I I 3 According to Mayor Turnbow, city employee Jay Reynolds has resigned to gO into business for himself, and applications are being taken for a replacement. Councilman Richardson presented a letter of resignation from the Ammo"n City Council effective April 6, 1973, necessitated by his having accepted employment in Seattle. He expressed his appreciation of having had the opportunity to serve on the Council for the past three and one-half years, and Mayor Turnbow commended him for the cooperation and dedication shown, and especially for his work on the recodification of the city ordinances and responsibilities taken in representing the city on the Bonneville Council of Gevernments. The need for a replacement for Councilman Richardson on the BCOG was considered by the Council, with Mayor Turnbow recommending Councilman Swensen. Councilman Richardson moved to appoint Councilman Swensen to represent Ammon on the Bonneville Council of Governments; seconded by Councilman Cheney; voting all in favor; motion carried. Councilman Swensen accepted the appointment. In response to an inquiry by Chairman Southwick, it was noted that a deed has been obtained for a 5-foot easement along the front of the property where a home is being built on the new extension of Romrell Lane. Mayor Turnbow referred to an application by Reuben Anderson for a building permit to I place a mobile home on a lot on Meadow Lane, and reported that the Building Permit Committee of the Planning and Zoning Commission has recommended a denial of this request on the basis that mobilehomes do not satisfy the requirements of the City Ordinance that all dwellings must meet the Uniform Building Code standards. The Council members indicated support for this decision. The problem of a mobile home now located on Owen Street having been brought in without a permit was discussed, and Councilman Swensen was asked to consult the attorney about the procedure for getting this unit removed. Council Richardson moved to adjourn. Claims were approved for payment. The meeting was adjourned at 10:10 P. M. 4Lc~7 ~1/yj}, ~rJ.~ Mayor CITY OF AMMON April 29, 1973 Minutes of Special Meeting of the Mayor and City Council: The meeting was called to order at 2:10 P. M. by Mayor Keith C. Turnbow at the City Hall with the following present: Mayor Keith C. Turnbow Councilman Marvin J. Anderson Councilman Gerald B. Cheney Councilman Russell N. Swensen Prayer was offered by Mayor Turnbow. A discussion was held in regards to a possible replacement for Councilman Lynn C. Richardson. Mayor Turnbow recommended that the Council reconsider the Building Permit of Everett Wray which was previously denied by the Planning and Zoning Commission and also the Arnmon City Council at their last meeting on April 23, 1973. Councilman Swensen moved that the Council reconsider the Building Permit of Everett Wray, #1484, and that it be approved and that a 2-foot side variance be allowed on the west side of the home. Seconded by Councilman Cheney; Voting--Anderson, yes; Cheney, yes; Swensen, yes; l1lotion carried. Councilman Swensen moved that the meeting be recessed until 9:00P. M. Monday, April 30, 1973.
