Council Minutes 01/08/1975 96' CITY OF AMMON January 8 , 1975 Minutes of the regular meeting of the Mayor and City Council: The meeting was called to order at 8 P. M. by Mayor Keith C. Turnbow with following City Officials present: Mayor Keith C.Turnbow C ounc ilman Marvin J. Ande r s on Councilman Gerald B. Cheney Councilman Brent Hirschi (Councilman Russell N. Swensen excused--out of town) Clerk Deon Hemingway Engineer David E. Benton Attorney W. Joe Anderson Prayer was offered by Councilman Anderson. Minutes of the meetings .of December 4, 1974, and December 18, 1974, were approved as typed. I There were ten (10) people present who were concerned with the L. 1. D#6 Assessment Roll Hearing. Others present were Larry Gust, Roland Romrell, and Mr. and Mrs. Lou Baribault. The Local Improvement District No. 6 Assessment Roll Hearing was conducted by Attorney W. Joe Anderson. (See official minutes prepared by Attorney Anderson for the L.1. D. #6 File.). The written roll showed an attendance of 10 people representing 6 properties. There was one (1) written protest from Warren Bird and wife stating that there had been an.error in property measure- ments in their assessment, which Engineer Benton will have checked out. After considerable discussion, it was apparent that most of the property owners present would like to have more detailed information on the figures and formula used to determine the individual assessments. As recommended by the Attorney, Councilman Hirschi moved that Engineer Benton and Attorney Anderson be authorized to make up a formula sheet on the assessment of L. 1. D. #6 to send <;>ut with notices of the continuation of the Assessment Roll Protest Hearing to February 5, 1975, 8 P. M. The motion was seconded by Councilman Cheney; voting was Hirschi, yes; 'Cheney, yes; Anderson, yes; motion carried. I Mr. and Mrs. Lou Baribault of 3170 Western Avenue requested a zoning variance which would allow them to add on to the front of their house to 20-1/2 feet from the front property line. It was noted that this request has been checked by the Variance Committee of the Planning and ZoniJ;lg Commision with a recommendation of approval having been made on the basis of other homes on the street being closer to the street than the required setback, so this additi.on would not disturb the appearance of the street. Also, the signatures of all property oWf!.ers within 200 feet showing no objection to this action was made of t:ecord. Councilman Cheney moved that the Council accept the Planning and Zoning Committee's recommendation to approve the variance. The motion was seconded by Councilman Hirschi; voting was all in favor; motion carried. Larry Gust indicated a desire to have a special meeting set up to explain to the re sidents the costs on the planned 17th Street improvements and the effect of this project on the property taxes. Mayor Turnbow suggested that Mr. Gust have a private meeting with Engineer Bento:/?- to get better informed on the 17th Street Project. Since payment to the L. 1. D. #6 contractor should be made in the near future, Attorney Anderson advised that funds could be obtained for this purpose before the bonds are sold by issuing an interim warrant. Councilman Cheney moved I that Interim Wa~rant .No. 1 for Local Improvement District No.6 for $24,787.00 be approved. The motion was seconded by Councilman Hirschi; voting all in favor; motion carried. An explanation by Mayor Turnbow of the present situation regarding the interim financing for the Water and Sewer Project resulted in a motion by Councilman Cheney authorizing Mayor Turnbow to write a letter to the Bank of Commerce agreeing to raise the interest on the Interim Warrants on the Water and Sewer Revenue Bond to the rate of 5.5% per annum effective December 23, 1974. The motion was seconded by Councilman Anderson; voting was Cheney, yes; Anderson, yes; Hirschi, yes; motion carried. According to Mayor Turnbow, the papers for closing the loan with Farmers Home I c ':J:j ...... :Q ::.:: u;J I I 97, Administration on the Water and Sewer Revenue Bonds will be reviewed at a meeting of the Project Engineers, the Attorney, and the City Officials on Monday, January 13. Attorney Anderson displayed types of binders for the Municipal Code Book which is being printed. Approval was given to purchase 25 of a kind available from Book Publishers at a total cost of $112.50. Reference was made to a letter prepared by Attorney Anderson to the Dep;:lrtment of Treasury, Office of Revenue Sharing, concerning the estimated population growth sincf' the 1970 Census. Mayor Turnbow indicated that the information in the Certificate which is to accompany the letter showing an increase in popu- lation to approximately 3, 492 is supported by reports on the new residence build- ing permits for the last two years. It was decided to defer sending this letter until the possibility is checked out of having a special census count'taken in the near future along ,with ,one which is to be done in the City of Idaho Falls. Information presented by Engineer Benton brought the City Officials up to date on the operation of Well #5 with the special valves installed. He also stated that most of the parts are now available for the pump for the new Well l\TO. 6. Engineer Benton noted that verbal approval has been given to start issuing permits .for the rest of the City on sewer connections, and the official letter will be forthcoming. The matter of needing to get the Eastgate Mobile Village sewer line hooked on to the new system was mentioned by Mayor Tur:r~bow so the collection of charges for water, garbage, and ,sewer services can be done through the manager or owner as of February 1. It was suggested that the Attorney should be asked to give an opinion on whether the charge for the, sewer service for the trailer court ,can come to the City of Ammon before the line is actually hooked on the system. Engineer Benton agreed to check on this an~inform the clerk. . .. Regarding the financing of the Water and Sewer Project, Mayor Turnbow announced that a letter has been sent to HUD giving authorization to have $10, 250 for the advance planning loan taken out of the payment from the grant funds which is being processed at this time so that the remainder of these funds will not have to be held up any longer. Consquently, thepro.ject engineer will have to come up with $10,250 . . . or show where this has been paid. Mayor Turnbow requ~.sted that Project Engineer Doug Jensen should be advised to get bids-.!or the work needed to be done on the d'iesel generators for the new we II. Regarding the 17th. Street Project, Mayor Turnbow reported that monies may be available soon, and asked that Engineer Benton work on getting the easements for for the right-of-way along Sand Creek. Councilman Hirschi reviewed the monthly and year-end report of the Fire Depart- ment. He reported that the cost of a radio for the new fire truck will be $683.00, and approval wasgiv~n by the Council to go ahead with this item. A report by Councilman Anderson indicated that information is being obtained from several dealers on the cost of a new 1-1/2 ton truck so that the purchase of this automotive equipment can be considered in .preparing the budget. According to Councilman Cheney, there are not as many boys participating in the basketball program this year because a similar program has been started in lona. Claims were approved f~:>r payment.
