Council Minutes 08/20/1975 ~ Regarding the 17th Stre.et proje.ct, it was noted that the bid should be let in the near future, but the paving work will not be started this year so the contractor that gets the bid will :nave to maintain .the road for travel as it is all winter long. 13f. Councilman Swensen mentioned that a copy of a letter regarding removal of Ammon from the flood -prone area ha.s been received, and official action to eliminate the re- quirement to obtain flood insurance when homes are bought is expected shortly. According to Councilman Cheney, there are some Scout Troops interested in pi ;king rocks off McCowin Park where grass is to be planted. A suggestion was made that Theron Beck of the Western Baseball League be contacted to see if some help is available on this project fr.om that organization. I With reference to the motion made in the meeting of July 22, 1975, setting a deadline of November 1, 1975, for sewer hC>okups to be completed, Mayor Turnbow noted that several inquiries have been made about whether there would be any granting of exten- sions for any individuals. The Council members felt that .no extensions should be given. Property owners with financial problems should be encouraged to loc>k into obtaining Title I. loans for home improvements. Mayor_ Turnbow reminded the Council that, if action is'to be taken on raising salaries for City Officials, it must be done 60 days before election. M. ~-(; r1~ MAY R CITY OF AMMON August 20, 1975 I Minutes of the "egular meeting of the Mayor and City Councii: The meeting was called to order at 8:45 P. M. by Councilman Marvin J. Anderson as acting Chairman of the City Council, with the following City Officials present: Councilman Marvin J. Anderson Clerk Deon Hemingway Councilman Brent Hirschi Attorney W. Joe Anderson Councilman Gerald B. Cheney Engineer David E. Benton (Mayor Keith C. Turnbow and Councilman Russell N. Swensen were out-of-town.) Others present during the meeting were Doward Kopp, Ton Infanger, Rodney Ragan, and Roland Romrel!. Prayer was offered by Councilman Anderson. Minutes of the meeting of Aug. 6, 1975, were approved as typed. I Prior to the opening of the meeting, Mr. Kopp of the local American Legion. post explained the programs which are sponsored by the organization for which funds are needed. He noted that circumstances had prevented the Post from having the dances at the tennis courts during June and July as planned, and requested that a change he made in the decision made by motion of the Council OR April 16, 1975, and allow a .!.ennis court dance on August 30, 1975. During the official meeting, Councilman Anderson made a motion to this effect, which was. seconded by Councilman Cheney. Voting .was all in favor; motion carried. Attorney Anderson presented a resolution for issuing Interim Warrant No.1 on L.1. D. #7 in the amount of $23, 248 for payment of Hartwell Excavating Company billing for work done on waterline on 17th Street. Amotion to adopt the resolution was made by Councilman Hirschi and seconded by Councilman Anderson; voting was all in favor; motion carried. On the matter of enacting an ordinance to increase the salaries of elected officials; Attorney Anderson recommended waiting until the Mayor and a full Council were .,.5 132 present It was decided to hold a special meeting at 7:30 A. M. on Monday, August 25, for this purpose. Mention was made that a letter making a recommendation on the amount of increase had been left by Mayor Turnbow. As advised by Attorney Anderson, the Coun:il approved a billing for G30dwin Construction Company for work done on the water storage tank under the Water and Sewer Project in the amount of $18, 347.89, with payment to be made by issuing an interim warrant on L. 1. D. #5. To clarify the city's policy regarding failure to appear on citations issuedfor violation of the dog leash law, Attorney Anderson explained that the officer is authorized to take such cases through the court procedure. (As a matter of I courtesy, the City Clerk usually notifies the defendant by letter that such action is to be taken, stating a final date for appearance in order to avoid going to court. ) Regarding a recommendation for the parking-in-the-street situation based on a study of street widths, etc., Engineer Benton reported that .he needed more time for this. An application for a variance to allow a garage to be built closer than the required 7 1/2 feet to the side -yard property line was placed before the Council for con- sideration. It was determined that there is approximately 10 feet of side yard on the north side of the.existing residence, and that the house on the south is 25 feet from the property line. Councilman Hirschi moved to grant the requested variance for Steven Tr.emayne, 3255 Ross Avenue, to build a garage within 3 feet of the prop- erty line. The motion was seconded by Councilman Cheney; voting was all in favor; motion carried. Attorney Anderson explained that there will be some delay in taking action on the item on the agenda regarding amending the zoning ordinance to delete the section which allows trailer courts in commercial zones, since the state law in effect since July 1, 1975, requires the Planning and Zoning Commission to hold hearings on all matters of this kind and then make recommendation to the City Council, after which another hearing must be held. He recommended that I this particular matter s:hould be included when there is a need to set up a hearing for some other business. Regarding the problem of dust at the business location of Waters Construction Company on Midway Avenue which Councilman Anderson mentioned had been brought to his attention, it was recommended that he make a personal contact with them about doing something to take care of this situation. A suggestion by Councilman Anderson that the north ends of Falcon Drive and Avocet Drive be finished on out .to the existing pavement on 17th Street was . referred to Engineer Benton. It was felt that this should be done .in order to make these areas good for travel during the winter and until the 17th Street Project gets under way. Mr. Tom Infanger of 3305 Sunnyside Road presented information in writing regarding a curb-ami-gutter problem along side of his prope.rty on Romrell Lane which needs to be repaired by the contractor under the Water and Sewer Project. Mr. Rodney Ragan, 2795 Salmon St., also appeared to request that action be taken to get repair work done on curb-and-gutter and driveway damage claimed to have been done .by the Project contra'ctor. Photographs which he felt substantiated his I claim were displayed by Mr. Ragan, and he mentioned that he had addresses to write to the Federal agencies involved and would consult a lawyer if necessary. Councilman Hirschi expressed regret in not having a representative of the con- tractor or the ProjectEngineer present to determine why this particular situa- tion had evidently been taken off the check list of repairs to be taken care of. Attorney Anderson recommended that the complaint be noted and referred to the Project Engineer; and, if it is felt that the claim is just, it will be corrected before there is a final payment on the contract. Mr. Ragan inquired about having livestock animals on the lot of a neighbor, noting that Protective Covenants for this area allowed for such animals and that he be- lieved the animals were there before the recodified code was adopted. Attorney I o 00 l'o ~ t:L:l ~ I I 133 Anderson explained that Protective Covenants. are a private matter and cannot allow what the City does not allow; also that livestock animals are prohibited in Mr. Ragan's nelghborhood under the Animal Overlay regulation. Mr. Roland Romrell appeared to request the help of the City in solving the problem of not being able to get sufficient water through the irrigation ditch culverts along the school and church properties to take care of his needs as a ditch user. Attorney Anderson explained that the City does not own or distribute the water and has no stand to require the property owners to unplug the ditch, so this would take action of the ditch users. According to Mr. Romrell, a former City Council authorized the school and church to install the culverts, and he felt that the City should be involved in getting the problem resolved. In response to his request that consideration be given to setting up a meeting to be chairmaned by the City with the people involved being invited, it was decided that this could be done and should be under the direction of Councilman Swensen who has been in. charge of maters pertaining to the irrigation ditches. Mr. Romrell remarked on the efficiency of the Volunteer Fire Department, noting that usually someone has the fire machines out of the building before the siren stops. M. the following city Officials present: Mayor Keith C. Turnbow Councilman Russell N. Swensen Councilman Brent Hirschi Councilman Marvin J. Anderson Councilman Gerald B. Cheney by Mayor Keith C. Turnbow, with Clerk Deon Hemingway Asst. Attorney Franklin Smith Engineer David Benton Others present were Glenn Smith, Allan Hemingway, and Mark Zohner of American Legion East Bonneville Post #139, and Robert Gray and William Manwill of the Bonneville County Engineer Office. Prayer was offered by Councilman Hirschi. The minutes of the meeting of August 20, 1975, were approved as typed. Glenn Smith, representing the local American Legion Pusit,expressed appreciation for the use of the City tennis courts for a dance the preceding Saturday, and asked to be on record for requesting the use of the tennis courts for two (2) dances next year--one each in June and July. Mr. Smith and Mr. Hemingway lnade comment on the good conduct of the young people who attended the dance, and indicated that the law enforcement officers told them that there were no problems observed. Regarding dances for next year, Mayor Turnoow asked for time to discuss this, since a proposal has been made to the County to use a location at Sandy Downs for outdoor dances in the future. Mayor T;Ul"nbow explained that County Engineer Robert Gray and Mr. Manwill were present to discuss a proposal to set up an agreement with Bonneville County to provide the service of Ammon's street sweeper in county subdivisions that have curb and gutter. It was noted that copies of the subdivision plats had.been sent to the Councilmen for study, and that there are approximately 11.21 miles of such streets, some. of. which would need to be swept two to three times per month while others would 'only be once a month, or less. In response to an i!1quiry by Mr. Gray regarding the anticipated cost, Mayor Turnbow quoted a figure of $23.00 per hour which he indicated would cover the use of the sweeper, the labor of the
