Council Minutes 9/12/2006 (77) I I I 113 March 6, 1997 CITY OF AMMON March 6, 1997 Minutes of the Regular Meeting of the Mayor and City Council: The meeting was called to order in the City Building, 2135 South Ammon Road, Ammon, Idaho, at 7:30 P.M. Council President W. Lee Bean called the meeting to order, and Mayor C. Bruce Ard arrived a few minutes later and conducted the remainder of the meeting after approval of the minutes. The following City Officials were present: Mayor C. Bruce Ard Councilmember W. Lee Bean Councilmember Sherrill C. Bohn Councilmember Ira K. Hall Councilmember Steven J. Joe Anderson The Pledge of Allegiance to the Flag was led by Councilmember Loveland, and the invocation was offered by Councilmember Bohn. Councilmember Hall February 20, 1997. The motion carried Unfinished Business: Engineer Benton reported on progress on Well No.8. member Bohn has entered the resident survey information on a data base. prepare to discuss the survey with the Council. Council- She will Regarding renewal of the kennel license for Gordon and Sue Sorensen, 3776 Marlene Street, an inspection was made by Public Works Director David Wadsworth and Animal Control Officer Adrian Owens. The Sorensens have nineteen dogs, mostly pups. The dogs are well cared for and the premise is very clean. It is difficult to prove whether or not the Sorensen's kennel is in violation of City ordinances. Based on representation by Sue Sorensen, it is believed they are not meeting the intent of the law, but there is no proof. The Council discussed what to do about the situation, and Attorney Brian Tucker provided input. It was determined that the license should be issued but a letter from our attorney should advise Sorensens that the City is not pleased with the number of dogs because there are more than the original application specified. Also, there is concern about cleanliness, the impact on the neighborhood, and breeding and sale of dogs which is not allowable. Councilmember Bean moved to approve renewal of the non-commercial kennel license for Gordon and Sue Sorensen with a letter from our attorney to state the City's concerns. The motion was seconded by Councilmember Hall. Roll call vote: Bean - Yes; Hall - Yes; Bohn - Yes; Loveland - Yes. The motion carried unanimously. Councilmember Bean recommended revising the animal control ordinance to tighten the requirements. The Council approved placing a stop sign on Sawtooth Street at Falcon Drive, but there is a problem. If the sign is placed where it should be, it is by a resident's driveway, and if the resident parks in his driveway, motorists can not see the stop sign. There has been concern about treneed for the sign on Sawtooth, but there is no record of an accident. Probably it is due to having the stop sign on Falcon Drive even though Falcon Drive should be the through street rather than Sawtooth. Public Works Director Wadsworth recommended leaving the signage as is, and the Council agreed. Councilmember Bean discussed investment of City funds to earn maximum interest. Ammon has been carrying too much money in the checking account which earns low interest. Key Bank has a sweep account available which will automatically move money from an investment account into the checking account as needed. In order to go with Key Bank's sweep account, they require a custody agent agreement executed by the City through their trust department. Councilmember Bean moved to accept the custody agent agreement and to authorize Mayor Ard or Councilmember Bean to sign the agreement. The motion was seconded by Councilmember Loveland. Roll call vote: Bean - Yes; Loveland - Yes; Bohn - Yes; Hall - Yes. The motion carried unanimously. It is necessary for the City CDL licensed employees in Transportation procedures as of Ammon to order to established adopt an official drug testing policy for be in compliance with Department of in 49 CFR Part 40 Drug Testing Program 114 March 6, 1997 and the Omnibus Transportation Employee Testing Act of 1991. A sample policy was reviewed. Attorney Brian Tucker agreed to check the law to determine if the sample policy meets all the requirements before the Council adopts it. Councilmember Bohn reported on updating the City Office computer. A quote was presented from NorTech Systems for a new computer. NorTech is operated by Mike Norris out of his home. The proposal utilizes MicroSoft Works. Councilmember Bohn wanted to make sure the recodification coming from the legal office is compatible so Ammon can have all the ordinances available in our computer. Councilmember Hall recommended the City may want to go bigger than proposed. Plans are to leave the existing utility billing, budgetary, and payroll programs on the computer now in use. The proposal from NorTech does not include a printer, but good printers are available at reasonable prices. Mr. Norris is readily available to assist the City, and he is concerned that the City gets a good deal. The Council authorized purchase of the computer package from NorTech. I Reports: Public Works Director Wadsworth outlined a long range road maintenance schedule for 1997 through 2005. The plan for 1997 is a major project on East 17th Street, but, if possible, we also need to redo some intersections and do some scrub coat maintenance. Areas needing attention were pointed out. Cushman Well Drilling of Blackfoot has been consulted about what to do with Well No.4. They have agreed to put a camera down to determine if the well should be abandoned or reactivated. Cost to camera the well is $475. Well No. 4 has not been used for a number of years because of sand. Engineer Benton recommended budgeting for a sand separator if the City decides to use Well No.4. Attorney Brian Tucker reported a trial was held on Tuesday, and a young man was convicted on two counts of battery involving violance in Kmart. Another case is scheduled for a woman charged with shoplifting and driving without privileges. Councilmember Bohn expressed concern about students and parents speeding on Midway Avenue in the vicinity of the schools. Lt. McBride of the Bonneville County Sheriff's Office has agreed to run some radar in the area. Counci1member Bean requested they also run some radar on the Ammon Road in the school zone. Mayor Ard has received a video called "Power Switch" from Electric organization interested in protecting electric utility shareholders. concerns deregulation, and it is available for anyone who is interested. u . S . A., an The video Counci1member Bean discussed the budget. He encouraged the Council to be cautious about what revenue will be coming in on sales tax. Revenue may come in under budget. It was suggested proceeding as budgeted with a review of the revenue figures later in the year. I Fire Chief Clarence Nelson reported for the Fire Department. Details of the fireworks spectacular for the grand opening of Target have been worked out. Mayor Ard visited Target's pre-opening. The manager expressed appreciation to Ammon for working with them during construction. Larry Schuldt, Building Inspector, reported on building permit activity during February. He has added a pager to his communication system. One permit has been issued for a manufactured home, and two other individuals have expressed interest in manufactured homes on Rich Lane. The foundation requirements for manufactured homes were discussed. It was recommended the City consider requesting a concrete test before the manufactured home is set on the foundation.
