Council Member Wheeler led the Pledge of Allegiance and Council Member Thompson offered a prayer. B.CONSENT AGENDA: a.Accounts Payable Report: Exhibit A b.Minutes: i.May 7, Regular Meeting ii.May 14, Work Session It was moved by Council Member Thompson and seconded by Council Member Wheeler to approve the consent agenda. aƚƷźƚƓ ƦğƭƭĻƭ ǒƓğƓźƒƚǒƭƌǤ ǞźƷŷ ǝƚƷĻ ĬǤ Ʃƚƌƌ ĭğƌƌ C.PROCLAMATIONS AND ANNOUNCEMENTS D.PUBLIC COMMENT REGARDING ITEMS NOT ON AGENDA (5-minute limit) There was no public comment E.PUBLIC HEARINGS: 2020-016 Bonneville County Fire District Administrator Austin detailed the guidelines for involvement in the hearing. Mayor Coletti provided a brief introduction to the hearing and read the letter sent to Ammon residents. Coletti added that Council hoped a mutual aid agreement would be implemented with City of Idaho Falls should the transition take place and that the paid-call model currently used by City of Ammon would only be implemented in Ammon City limits and that no plans existed to transition the entire district to the same model. Mayor Coletti added clarification on a few questions that had been brought forward: Q. How will this affect EMS? A. There will be no effect to EMS at all. Q. Will Ammon be called to fires in the county? A. Not unless Idaho Falls (which manages the County contract) requests assistance. Q. What if there are two fires in Ammon? Who will handle them? A. Ammon firefighters will handle both, just as they always have. Q. What does this have to do with the Idaho Falls contract with the Fire District? A. Nothing. This is only a question of whether joining the Fire District benefits Ammon residents and businesses. Plain and simple. It has nothing to do with the Idaho Falls contract with the Fire District for the rest of the county. Q. ervices? A. We have considered that. But at the end of the day, we were concerned with ongoing expected and unsustainable cost increases and a change in fire department culture. Not necessarily that it was a change for the worse, but it was a change that we did not want to see occur, because we want to preserve the culture that currently exists with Ammon Fire. Q. If Ammon joined the Fire District, would Ammon firefighters become employees of the Fire District? A. Yes. Q. But the Fire District does not have any employees. A. But obviously that would be different if Ammon joined the Fire District. Ammon firefighters currently stationed at the Ammon station would continue to handle fires in the City of Ammon, but would be employees of the Fire District. Q If Ammon joined the Fire District, since Idaho Falls Fire handles the Fire District contract, would IF Fire then fight fires in Ammon? A No, IF Fire would continue to fight fires in the remaining county areas. Ammon firefighters would fight fires in Ammon. Ammon City Council 06/02/2020Page 3 of 9 Mayor Coletti then opened the public hearing for input. Seeing no comments, either in person or via Zoom, and with no attendees present to comment, Mayor Coletti closed the public hearing and entered back into regular business. F.ACTION ITEMS: a.Ordinance 637 and Summary LID #3 (Micah Austin, City Administrator) Administrator Austin reviewed the presented Ordinance, the final step to setting up LID #3, to Council. The presented Ordinance allows the City to present bonds for payment. Austin added that the final interest rate was 2.8%. Recommendation - Staff recommends adoption of Ordinance 637 and Summary, waiving the three readings. Summary of Analysis 1. Ordinance 637 authorizes the City to issue a Series 2020 bond in the amount of $783,195.93. 2. This bond pays the City of Ammon back for all construction completed on LID3 3. After the bond is issued, the property owners that have opted into LID3 will repay the bond over the next 15 years. 4. The bond will be sold to Washington Federal Bank. They will administer the bond for the duration. Financial Impact - Ordinance 637 obligates LID 3 to pay back the bond over the next 15 years from the residents within LID3 that have opted into the local improvement district It was moved by Council Member Wheeler and seconded by Council Member Wessel to dispense with the rule requiring the reading of the ordinance on three different days and that the three readings be waived. aƚƷźƚƓ ƦğƭƭĻƭ ǒƓğƓźƒƚǒƭƌǤ ǞźƷŷ ǝƚƷĻ ĬǤ Ʃƚƌƌ ĭğƌƌ It was moved by Council Member Wheeler and seconded by Council Member Wessel to adopt ordinance No. 637 and Summary as an ordinance of the City of Ammon on its third and final reading. aƚƷźƚƓ ƦğƭƭĻƭ ǒƓğƓźƒƚǒƭƌǤ ǞźƷŷ ǝƚƷĻ ĬǤ Ʃƚƌƌ ĭğƌƌ **At 8:29pm, Council President Slack joined the meeting in person b.Comprehensive Plan Land Use Map Amendment (Cindy Donovan, City Planner) Austin briefly introduced items b and c on the agenda explaining that two requests had come into the City for review. Should Council choose to amend the Comprehensive Plan, they would then discuss a rezone of the requested property. Director Donovan reviewed specifics of the request and the areas being impacted. The developers are looking to rezone the area from commercial to medium to high density residential. Donovan also reviewed the appropriate sections of City Code related to amendments to the Comprehensive Plan. Developer Dan Larsen, 494 S 390 E Hyrum, UT, shared a presentation with Council reviewing the plans for the project including townhomes and outdoor areas. Council and the developers discussed the implications of the property change. Recommendation - Staff recommends: approval Summary of Analysis - Parcel is currently residential in Bonneville County - All lots on the south side of Wanda have the portion of property where the house is located in the City and the back portion of their property in Bonneville County. - Parcel will remain residential if annexed Parcel Characteristics - Requested initial zoning: RP-A - Total acreage: 0.91 acres - Property is located north of north of Sunnyside Road, west of 45th East (Crowley Road), south of Wanda Street, east of Princess Drive - Request being presented by Paul Stierle - Annexation of 0.91 acres with an initial zoning of RP-A, to combine property to all city property Notice - Letters were mailed out to 21 property owners and 18 public entities on April 2, 2020 - Published in the Post Register on April 2, 2020 and April 9, 2020 - Property was posted on April 20, 2020 - Public comment: 1 letter received included in the packet Planning and Zoning Commission - Public hearing was held on May 6, 2020 - Oral testimony from 2 residents concerned with the zone being allowed to include commercial one of the residents also wrote the one letter included in the packet - One resident spoke to the comments by the other residents to answer questions - Reasoned statement: makes sense to consolidate property to all city property, no change to zone from current neighborhood Compliance with Zoning Ordinance - 10-13-1: GENERAL OBJECTIVES AND CHARACTERISTICS OF ZONE: The objectives in establishing the RP-A Residence Zone is to provide a residential environment within the City which is characterized by smaller lots and somewhat denser residential environment than is characteristic of the RP Residence Zone. Nevertheless, this zone is characterized by spacious yards and other residential amenities adequate to maintain desirable single-family residential conditions. This zone falls under the low density designation and does not allow density that will exceed 2.5 living units per acre. Mayor Coletti reported on the direction for LID #5 and announcing plans for sign ups and garnering interest. Coletti brought up the opportunity for a sponsored firework show in lieu of the normal celebration that has been cancelled.
