Bruce Ard at 7: 30 P.M. in the City Building, 2135 South Ammon Road, Ammon, Idaho, with the following City Officials present: Mayor C. Bruce Ard Councilmember W. Lee Bean Councilmember Sherrill C. Joe Anderson The Pledge of Allegiance to the Flag was directed by Counci1member Hall, and Counci1member Bohn offered the invocation. Mayor Ard opened the Public Hearing of the City Council acting as the Board of Adjustments to consider the request of the Snake River Montessori School, 2660 East First Street, for a conditional use permit. Parties in interest were sworn in. The school is in need of additional classroom facilities, and they would like to use a trailer for approximately a year until they are able to add on to their building. Fire Marshal Ca1 Smith performed a fire safety inspection of the proposed mobile unit on September 12, 1997. Jill Schurman, School Administrator, was present during the inspection. The trailer is 12' X 56', and it is a rented unit similar to ones which have been used at Hi11view School. The Fire Department inspection indicated the illuminated exit signs are mi.ssing, there is no fire alarm system installed, and a portable fire extinguisher is needed. School personnel are working to correct the problems indentified. There is no problem with temporary use provided the corrections are made. Larry Schuldt, Building Inspector, also inspected the trailer. The trailer needs tie downs. ADA requirements are provided in the main building, and they should be sufficient since the trailer is to be temporary. The Planning and Zoning Commission recommended approval of the conditional use permit for the temporary trailer. Notice of Hearing was published in the Post Register on September 16 and September 23, 1997. Property owners within three hundred feet were mailed notices. Mayor Ard closed the Public Hearing and called for Council action. Counci1member Bean moved to approve the conditional use permit for the Snake River Montessori School to allow them to use a temporary trailer for a year with the understanding that the illuminated exit signs will be installed within the next thirty days. The motion was seconded by Councilmember Loveland. Roll call vote: Bean Yes; Loveland - Yes; Hall - Yes; Bohn - Yes. The motion carried unanimously. Lucinda Stroschein, 3075 Geneva Drive, requested a home. occupation permit for Inspired Images, a photography business. She does various types of photography. There will be no developing/processing in the home. Photo sittings will be by appointment. Advertising will be by word of mouth. She is not doing any photography work at this time, but she has done it in Washington before moving to Idaho five years ago. She has been thinking about the idea for some time and is making plans to activate her ideas. In time she may move toward a commercial operation. Councilmember Bohn moved to approve a home occupation permit for Lucinda Stroschein, dba Inspired Images, 3075 Geneva Drive. The motion was seconded by Councilmember Hall. Roll call vote: Bohn - Yes; Hall - Yes; Bean - Yes; Loveland - Yes. The motion carried unanimously. 155 October 2, 1997 Brock Walker, a student at Sand Creek Middle School, suggested improvements to the walkway bridge across the canal at the west end of Rawson Street. A ramp is needed, and the bars in the middle need to be removed. This would make it possible for wheel chairs and bikes to use the bridge. Brock was advised that the school installed the bridge, and the school should be contacted about any changes. Glenn Peterson was recommended as a good contact person. Councilmember Hall moved to approve the minutes of City Council Meeting held September 18, 1997. The motion was seconded by Councilmember Bohn. Roll call vote: Hall - Yes; Bohn - Yes; Bean - Yes; Loveland - Yes. The motion carried unanimously. Unfinished Business: No report has been received on the Well No. 8 settlement. H- K has been engaged to raise the four extra manhole/water valves at an estimated cost of $150 each. It is time for the annual newsletter. The Council brainstormed items to be included. Areas mentioned were enforcement of ordinances, building permits for all types of construction including sheds, home occupation permits, burning permits, winter guidelines, and rate increases. Plans are to mail the newsletter with the coupon books near October 20, 1997. A clarification was requested for the increased water rate to be charged for the two unit townhouses. It was determined each of the units is to be charged at the same rate as a single family dwelling in the R-l zone. Building permit plan check fees were reviewed. At the last Council Meeting it was decided to require upfront payment of a portion of the plan check fee to eliminate being left with the expense of completing the plan check if the building permit is not purchased. An upfront fee was suggested, but it needs to be revised because it turned out to be unrealistic. Building Inspector Larry Schuldt provided input to the Council on how the plan check fee is calculated. I Councilmember Hall inquired at the cost of building permits. The fee we are charging seems high especially for accessory buildings. Procedures were discussed. City of Ammon uses the Uniform Building Code guidelines in determining fees. Our fees are comparable with City of Idaho Falls except for the plan check fee. We charge 65% of the permit fee for plan check fee. City of Idaho Falls uses a lesser I plan check fee schedule. Following discussion, it was decided there is no problem with the procedure Ammon is following. Jeff Metcalf, 2020 Curlew Drive, reported there is a street light post missing near Lion's Park. Teenagers have a tendency to gather at the park late at night and disturb the neighborhood. It is very dark, and he suggested the Council plan to add a street light in that area. There is already two lights in the park, but the Council agreed to look into another one at the intersection of Curlew and Salmon. The Sheriff's Department will be asked to patrol the area. Ammon has a Juvenile (age of 18 years) Curfew ordinance. Curfew hours are between 1:00 A.M. and 5:00 A.M. every day of the week. Jeff Metcalf pointed out another concern is the problem they are experiencing with the neighbors regarding dogs. The neighbors are abusing dogs. Metcalfs have been documenting the abuse and working with Attorney Brian Tucker to correct the problem. As a result the neighbors have filed complaints against Metcalfs for having more than two dogs and no kennel license. City involvement and citizen rights were discussed. Abuse should not be tolerated. Three dogs require a kennel license. Reports: David Wadsworth reported for Public Works. An information sheet was circulated on safety factors relating to children at play, lower speed limits, addressing the safety of young children, and false sense of security created by signs. Jason Byington is supposed to do a handicap ramp for the bridge across the canal at the end of Salmon Street. H-K has completed the street improvements on Southwick Lane, Circle S Drive, and the intersection at Midway and Southwick. Sod has been placed as planned on the ball fields in Peterson Park and McCowin Park. The drug testing program for CDL licensed drivers has been started. Two additional water lines have been installed in Lion's Park. Preliminary work has been done for the Peterson Park sprinkler system. An inquiry has been received from a restaurant that is interested in locating in Ammon Town Center. Attorney Brian Tucker reported their office has not heard from Mike Norris about the suit filed for refund of the money paid for the computer that was not delivered. If they do not hear by October 7, legal counsel will be in a position to file a default judgement. Councilmember Loveland has asked Karen Dobson to head a committee for the new playground equipment in McCowin Park. I I I I 156 October 2, 1997 Councilmember Bohn reported a grant writing workshop is scheduled for the middle of October. Councilmember Hall pointed out that information sent out by AIC in City Report stated U. S. West has some grant monies available. (Applications were due by October 6, 1997.) Councilmember Bean asked when the cement curb will be completed for the Peterson Park playground equipment. The committee asked Councilmember Loveland about forms but he does not have enough for the project. He maybe able to get some forms from another source. It would be good to complete the project before winter. Councilmember Hall and Public Works Director Wadsworth agreed to contact Mrs. Webster on First Street to see if she is interested in including her property in the Ashment annexation. They learned Mrs. Webster has died and the property is up for sale. Engineer Benton advised it may require a zoning hearing if we plan to annex the Webster property. Annexation procedures were discussed. When considering .to include contiguous lands in annexations, Engineer Benton suggested the Council give thought to fire protec- tion, law enforcement, and what revenues the City can expect to realize to help provide services. Discussion continued on the boundaries for the Ashment annexation. Engineer Benton stated he plans to prepare the legal description to the east side of Sand Creek. However, there is a question about whether or not to do anything about First Street from Sand Creek to Hitt Road and about Suitter's house which was not included in the Suitter farm annexation. Engineer Benton inquired about extending the sewer to the Suitter property and to the Ashment property. It is possible to extend the sewer to these properties by accessing to the Idaho Falls' sewer. Benton agreed to get some maps and informa- tion available for the Mayor to meet with City of Idaho Falls to obtain permission. Fire Chief Nelson reported for the Fire Department. He handed out a monthly report. Keith Christensen has delivered an air compressor for the department to tryout. The compressor is planned in the 1998 fiscal year budget. Mayor Ard reported on the BMPO Meeting of October 1, 1997. BMPO is interested in restructuring, but Idaho Falls does not want to change. The Ada County Metro Planning Organization has separated themselves from the City of Boise, BMPO wants to take similar action. A representative from Boise plans to come to Idaho Falls to discuss their restructuring process. Public Works Director Wadsworth brought up billing of apartment complexes. There is one duplex which is not set up for the owner to pay the utilities. The City is billing each individual unit, but there is only one waterline. Other units in the City are billed to the owner, and he collects enough in the rent to pay for City services. There is a problem with the units being billed to the individual occupants because one of the occupants is behind on his account. The City is not able to force payment by turning off the water. The City has tried to get the owner to pay the City, but he refuses. The City Office understanrnwe cannot make the owner pay, but such an agreement has to be voluntary on the part of the owner. If we can not get the owner to be responsible, is it worth it to the City to put in a separate service line? The attorney agreed to recommend some options. Claims were approved.
