The Pledge of Allegiance to the Flag was directed by Mayor Ard, and the invocation
was offered by Councilman Hall.
At the suggestion of the Transportation Department Engineer on the Ammon
Road project, Lennis Tirrell attended City Council meeting to request approval for
plan changes by his store, Ammon Speedi Mart. Mr. Tirrell reviewed the design
plans to show the curb, gutter, and sidewalk placement. He presented sketches and
proposed to pay any additional costs to extend the curb and gutter on the east side
of his store from where the design plan ends to the south boundary of his property.
This leaves approximately eleven feet (11') between the store and the curb. He
further proposed to pour a four foot (4') sidewalk next to the building and asphalt
the remaining seven feet (7') to be utilized for parallel parking. He also
discussed his plans to improve drainage on the south end of his property. The
Council did not recognize a problem with the proposal and granted Lennis Tirrell
approval provided he assumes costs and he works out satisfactory details with the
state and the contractor.
Michele Davis, 2450 South Ammon Road, questioned why the newly reconstructed Ammon
Road is planned for 40 miles per hour speed limit. She opposed increasing the
speed from the present 35 miles per hour to 40 miles per hour because the road
serves a family oriented area. A number of people along the road own livestock,
school children have to cross Ammon Road, and there is a church center which
accesses on the road. Transportation Department Resident Engineer Devin Rigby
discussed road signing, and he stated that the speed limit is normally set by past
history. Apparently no historical data is available for Ammon Road between East
17th Street and East Sunnyside Road. He suggested the speed limit be set according
to the Council's best judgement. Attorney Anderson recalled that state statutes
require a traffic study in order to change speed limits. Recommendations were to
consult the City Engineer, to get input from residents on the road, and to check
with Forsgren Associates to determine if there was a reason for the 40 mile per
hour speed limit. The Council assured Michele Davis that they would investigate
the issue further before the road is signed.
Mayor Ard continued the discussion on Ammon Road. Residents have expressed concern
about the plans to restore those areas where trees have been removed or other
destruction has occurred. Devin Rigby advised that restoration plans are to bring
in fill dirt, and it will be as good material as they can find. However, the
residents can expect rocks in the fill dirt. The LDS Ammon Stake Center has
expressed concern that their south entrance is too steep and the low sidewalk may
require a retaining wall. Plans are to cut back and slope all property and
driveways to produce a satisfactory match between the new road and existing areas.
The State Transportation department has tried to make adjustments to accommodate
the people. Paving is scheduled to begin July 26. Trees will be planted in the
fall, and the residents will have a choice of four varieties.
Engineer Devin Rigby requested the City Council input on two requests to modify
the irrigation system on Ammon Road which were received from Progressive Irrigation
Company. The first request is to install a gate in the irrigation structure across
from Molen Street to control the water going south. This will aid in the
maintenance of the line and provide security for Progressive Irrigation. Cost of
the gate is estimated to be $2,000. The second request is for installation of a
locking system on pasture valves from Molen Street north. There are approximately
ten locations where the pasture valves need to be secured to insure adequate
delivery to other water users. The locking system is estimated to cost $1,500.
The Council agreed the City has a responsibility to participate in the installation

of the gate, and Engineer Rigby was authorized to process that change. There was a
problem with the locking system, and it was questioned whether that is the
responsibility of the individual property owner or the City. It was decided the
Transportation Department would request Progressive Irrigation to design a locking
system for the City and the Transportation Department to consider. The change
order will not be completed until both requests are decided upon.
Councilman Hall asked about when the new Ammon Road should have a seal coat.
Engineer Rigby advised there are differences of op~m.on, but the state
specifications now require a road to sit over a summer before seal coating. He
recommended since it is late in the year that the City wait to seal coat Ammon Road
until next summer.
Councilman Maeser moved to approve the minutes of City Council meeting held July I
1, 1993. The motion was seconded by Councilman Anderson. Roll call vote: Maeser-
Yes; Anderson - Yes; Hall - Yes. The motion carried.
Residents have expressed concern that some relatives of the family at 3470 Rawson
Street are living in tents. This creates a problem and probably violates the
zoning ordinance or regulations for occupancy without necessary sanitary
facilities. Public Works Director Wadsworth was asked to check out the problem.
An offer has been received from Sessions Management to purchase the Well No.7
property. Figures were lower than the Council believed the property to be worth.
Councilman Crandall has been asked to study the offer and to make a recommendation
at a later date.
The development of Tie Breaker Park was discussed. Some ground preparation has
been started, and the sprinkler system is in the planning stages. The driveway
by Olson's will be postponed for the time being. Kathy Dansie and Caralyn Olson
should work together to determine if Olson's request on trees and shrubs will work
out with the overall park plans already developing.
Mayor Ard explained the following letter from Attorney Anderson to Lane Archibald
of Bonneville Land and Title regarding the Monty Howell Addition/Denny Austad
option:
I was referred the letter you wrote to Mayor Bruce Ard on July 6th con-
cerning the Quitclaim Deed held by the City of Ammon for a right-of-
way through Lot 2, Block 5, Monty Howell Addition, Division No.2.

You expressed that Mr. Austad had an option to buy the property and de-
sired to change the location of the easement and felt that the
outstanding Quitclaim Deed would be detrimental to his acquisition and
financing.
The City has determined that the easement, as provided by the Quitclaim
Deed, is not in a particularly desirable location and is willing to have
that vacated if there is an acceptable alternate presented in the form
of an amended plat. We understand. that Mr. Austad is contemplating
presenting another plat which would provide for adequate and
satisfactory easements and accesses.
For Mr. Austad's assurance that the Deed will not be utilized and
recorded pending his submission of amended plat, we are enclosing the
Deed and ask that you hold it until such time as the amended plat is
filed and recorded after acceptance by the City, and then this could
be destroyed.
In order to make record of the action taken, Councilman Maeser moved to approve
the action outlined in the letter to Lane Archibald from Attorney W. Joe Anderson
dated July 13, 1993. The motion was seconded by Councilman Hall. Roll call vote:

Mayor Ard asked the City Council to submit any budget recommendation as soon as
possible.
The law enforcement contract was discussed. Since the new sheriff took office in
January 1993, no formal agreement has been made with Bonneville County for 1993FY
and no payment has been made to the county. It was recommended the sheriff be
invited to City Council meeting on August 5, 1993, to discuss law enforcement
coverage and to establish good relations.

Fire Chief Cal Smith reported advertisement has been made for fire truck bids.
Sealed bids will be accepted until July 30, 1993, at 2:00 P.M.
Councilman Anderson reported for the Parks and Recreation Department. The committee
working on the July 24th Pioneer Day Celebration has requested permission to make
two additional horseshoe pits at McCowin Park. They will make temporary pits and
restore the area as is or they will build permanent pits whichever the City Council
prefers. It was agreed that additional permanent pits are not needed, but the
committee has approval to create two temporary pits provided they completely
eliminate them after the celebration.
A resident requested Councilman Anderson to check out the legality of one resident
piling dirt against a fence built by another resident. It was determined this to
be a problem to be worked out with neighbors. Nothing can be done as long as each
is on his own side of the fence.
Councilman Maeser inquired about the action taken or to be taken against the boys
involved in the restroom vandalism at Peterson Park. Damage was not great, but the
individuals need to have respect for public property. Vandalism is continually
happening, and the City needs to establish control. No action was decided on.
Bonneville County has made plans to test the new enhanced 911 line.

Regarding road maintenance, the County can not help us with any scrub coating or
seal coating this fall. However, they will be able to help us in the spring. A
private contractor could help Ammon this fall, but the expense would be greater.
The County suggests we wait and they will give us priority. By waiting for the
County we will realize more for our investment. Councilman Maeser encouraged paving
Williams Street by Hillview School before winter. It was decided to patch bad spots
now, to wait until spring for Bonneville County to help with major maintenance, and
to put together specifications for paving the Hillview School area as soon as
possible.
The Mayor reported the Flood Control District has expressed concern about the
proposed development of the Eastgate Shopping Center property on East 17th Street
and Hitt Road. They are concerned if Sand Creek and/or the canal is covered and
put in pipe will it carry the water if flooding should occur.
Claims were approved. Councilman Maeser moved to adjourn the meeting, and the
motion was seconded by Councilman Hall. The meeting was adj ourned at 9: 20 P.M.
