CHAPTER 11 Title 5 Air Guns and Firearms CHAPTER 11 AIR GUNS, FIREARMS SECTION: 5-11-1: Definitions 5-11-2: Repealed 5-11-3: Discharge of Firearms Prohibited 5-11-4: Exceptions; Permits 5-11-5: Penalty 5-11-1: DEFINITIONS: Whenever the term “firearms” is used in this Chapter, the term shall mean any instrument used in the propulsion of shot, shell, or bullets or other harmful objects by the action of gunpowder exploded within it or the by the action of compressed air within it, or by the power of chemicals, springs, bowstrings, rubber bands, or other applied force, including guns, air rifles, B-B guns, bow and arrows, crossbows, slings, flippers, and similar devices capable of inflicting serious bodily injury or death. 5-11-2: CONCEALED WEAPONS: REPEALED – See Idaho Code, 18-3302. 5-11-3: DISCHARGE OF FIREARMS PROHIBITED: It shall be unlawful for any person to discharge firearms of any kind or description within the city limits except in the lawful defense of person or property; provided, however, that this section shall not apply to police officers in the lawful discharge of their duties. Any person violating the provisions of this section shall be deemed guilty of a misdemeanor. 5-11-4: EXCEPTIONS; PERMITS: Any time the City Council may, upon application, grant permits to shooting galleries, gun clubs, and others for shooting within the city limits in fixed localities and under fixed rules. Such permits shall be in writing attested by the Clerk conforming to such requirements as the City Council shall demand, and the permit thus issued shall be subject to revocation at any time by action of the City Council. 5-11-5: PENALTY: Persons violating the provisions of this Chapter shall be subject to penalties set by the State of Idaho by Statute or as stated by provision of this chapter.
